' OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING A TIME EXTENSION FROM
DECEMBER 6, 2001 TO OCTOBER 19, 2002 FOR THE
PALM SPRINGS CLASSIC (CODA) PRELIMINARY
PLANNED DEVELOPED DISTRICT (PD-231) AND
TENTATIVE TRACT MAP 28033, LOCATED AT THE
SOUTHEAST CORNER OF GENE AUTRY TRAIL AND
VISTA CHINO, W-M-1-P AND 0-5 ZONES, SECTIONS 7
AND 18.
WHEREAS,Tuchscher Development Enterprises, Inc.,(the"Applicant")requests approval
of a time extension for Preliminary Planned Development District(PD) 231 and Tentative
Tract Map(TTM)28033 for property located at the southeast corner of Gene Autry Trail and
Vista Chino, (the "Project"), W-M-1-P and 0-5 Zones, Sections 7 and 18; and
WHEREAS, Applicant has requested additional time to October 19, 2002 to record the
approved subdivision and have final development plans prepared and approved; and
WHEREAS, notice of a public meeting of the City Council of the City of Palm Springs to
considerApplicant's application for a time extension from December6,2001 to October 19,
2002 for TTM 28033 and for PD 231 was given in accordance with applicable law; and
' WHEREAS,the City Council has independently reviewed all evidence provided, including
the staff report dated November 7, 2001 and all otherwritten and oral testimony, and finds
the Project, subject to the original conditions of approval, consistent with the requirements
of the ordinances of the City and State law;
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs,
California,after considering the evidence provided atthe meeting,does hereby approves the
time extension from December 6,2001 to October 19, 2002 for the tentative tract map and
the planned development. The City Council hereby approves the extension of the current
processing agreement and grants this time extension to allow the continuation of processing
the CODA project. Should the project be withdrawn the extension shall be rescinded and
the Tentative Tract Map and Planned Development shall be deemed expired.
