HomeMy WebLinkAbout19927 - RESOLUTIONS - 10/18/2000 RESOLUTION NO. 19927 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING, SUBJECT TO THE CONDITIONS STATED, TENTATIVE PARCEL_ MAP NO. 29631, TO CREATE TWENTY-THREE (23) PARCELS LOCATED ALONG THE EAST SIDE OF GENE AUTRY TRAIL, SOUTH OF THE PALM SPRINGS CLASSIC PROJECT AND NORTH OF RAMON ROAD, M-1-P ZONE, SECTION 18, AND MAKING FINDINGS IN SUPPORT THEREOF. WHEREAS, CS31F Partnership, (The "Applicant") has filed an application with the City pursuant to Section 9402.00 of the Zoning Code and the Palm Springs Municipal Code Section 9.60 for the Tentative Parcel Map to create seventeen parcels along the east side of Gene Autry Trail, south of the Palm Springs Classic project, and north of Ramon Road (The "Project"), M-1-P Zone, Section 18; and WHEREAS,the applicant has filed Tentative Parcel Map 29631 with the City and has paid the required filing fees; and WHEREAS,said Tentative Parcel Map was submitted to appropriate agencies;as required by the subdivision requirements of the Palm Springs Municipal Code, with the request for ' their review, comments and requirements; and WHEREAS, notice of a public hearing of the Planning Commission of:the City of Palm Springs to consider Applicant's application for Tentative Parcel Map 29631 was held by the Planning Commission in accordance with applicable law; and WHEREAS, on August 23, 2000 and continued to September 13, 2000, a public hearing on the application for Tentative Parcel Map 29631 was held by the Planning Commission in accordance with applicable law; and WHEREAS, on September 13, 2000, the Planning Commission voted to recommend approval (5-0; one abstention, one absent)to the City Council of Tentative Parcel Map No. 29631through adoption of its Resolution No. 4710; and WHEREAS, notice of public hearing of the City Council of the City of Palm Springs to. consider Applicant's application for Tentative Parcel Map No. 29631 was given in accordance with applicable law; and WHEREAS, pursuant to Government Code Section 66452.3, City staff prepared a written report for the City Council with the Planning Commission recommendation that the proposed subdivision, Tentative Parcel Map No. 29631 be approved, and that a copy of that report was served upon the subdivider along with recommended conditions of approval at least three (3) days prior to the aforementioned meeting; and WHEREAS, on October 18,2000, a public hearing on the applications forTentative Parcel Map No. 29631 was held by the City Council in accordance with applicable: law; and 1 ,3 R19927 Page 2 WHEREAS, the proposed Tentative Parcel Map No. 29631 is considered a "project" pursuant to the terms of the California Environmental Quality Act(CEQA); and a Mitigated Negative Declaration has been prepared for this project and has been distributed for public review and comment in accordance with CEQA; and WHEREAS, pursuant to Government Code Section 66412.3, the Planning Commission has previously considered and the City Council has independently considered the effect of the proposed subdivision,Tentative Parcel Map No. 29631,on the housing needs of the region in which Palm Springs is situated and has balanced these needs against the public service needs of its residents and available fiscal and environmental resources; the approval of the proposed subdivision represents the balance of these respective needs in a manner which is most consistent with City's obligation pursuant to its police powers to protect the public health, safety and welfare; and WHEREAS, at the conclusion of its public hearing on October 18, 2000, the City Council approved Tentative Parcel Map No. 29631 subject to the findings herein and conditions as stated in Exhibit A; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project,including but not limited to the staff report, all environmental data including the initial study, the proposed Negative Declaration, and all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council finds as follows: The final Mitigated Negative Declaration has been completed in compliance with CEQA, the State CEQA guidelines, and the City's CEQA procedures contained in the City's CEQA guidelines. The Planning Commission has previously reviewed and considered and the City Council has independently reviewed and considered the information contained in the Negative Declaration and finds that it adequately discusses the significant environmental effects of the proposed project, and that, on the basis of the initial study and comments received during the public review process, there is no substantial evidence that there will.be any significant adverse environmental effects as a result of the approval of this project. The City Council further finds that the Mitigated Negative Declaration reflects its independent judgement. Section 2: Pursuant to Government Code Section 66473.5,the City Council finds that the proposed subdivision and the provisions for its design and improvement are compatible with the objectives, policies and general land uses and programs provided in the City's General Plan; and Section 3: Pursuant to Government Code Section 65567, the City Council finds that the proposed subdivision and improvements are compatible with the objectives, policies and general land use provided in the City's local open space plan; and Section 4: Pursuant to Government Code Section 66474, the City Council finds that with the incorporation of those conditions attached in Exhibit A: a. The proposed map is consistent with the applicable general and specific plans. lie Z R19927 Page 3 This site is designated as Business/Industrial on the General Plan Land Use Map. The proposed parcel map is for the purpose of future industrial development consistent with the General Plan designation and the zoning designation of M-1-P ' (Planned Research and Development Zone),consistentwith the intent forthe area in the City's General Plan. b. The design or improvements of the proposed subdivision are consistentwith the General Plan . The subdivision design, including lot size and public right-of-way width, is consistent with the General Plan and shall comply with all applicable development criteria for the M-1-P Zone. The proposed subdivision map implements design strategies and policies as referenced in the City of Palm Springs General Plan-for Business/Industrial development. c The site is physically suitable for the type of development contemplated by the proposed subdivision. The subject site is generally flat and level, with no significant landforms, and is physically suitable forthe type of development which is allowed in the M-1-P zone district. The proposed lots within the subdivision have been designed to comply with all applicable property development criteria specified for the M-1-P zone district. d. The site is physically suitable for the proposed density of development contemplated by the proposed subdivision. ' The proposed subdivision of land does not contemplate any development at this time. However, any future development on the parcels created by this subdivision will be required to comply with the applicable provisions of the M-1-P Zone District. Again,the proposed lots within the subdivision have been designed to comply with all applicable property development criteria specified for the M-11-P zone district. e. The design of the subdivision or improvements are not likely to cause substantial environmental damage or substantially and unavoidably injure fish or wildlife or their habitat. An environmental assessment has been conducted in regards to the proposed subdivision and itwas determined,with the recommended mitigations incorporated into the attached Conditions of Approval,the proposed subdivision and associated improvements will not cause substantial environmental damage; or substantially and unavoidably injure fish, wildlife or their habitat. f. The design of the subdivision or improvements is not likely to cause serious public health problems. The design of this subdivision and associated improvements will Iprotectthe public health, safety and welfare through installation of public improvements such as curbs, sidewalks,drainage improvements and traffic control devices, as applicable. ' g The design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of the property within the proposed subdivision. 13 R19927 Page 4 The proposed subdivision will not conflict with any public easements as none currently exist on the property, nor will the proposed subdivision conflict with the existing traffic flow adjacent to the property on all surrounding streets or access to utilities required to serve the subdivision and the immediate area. h. A nexus and rough proportionality have been established for requirement of dedication of the additional right-of-way to the City and the off-site improvements as related to the tentative parcel map. The right-of-way dedication and off-site improvements,which are required by the Zoning Ordinance, are related to the project since the property owners must use Gene Autry Trail to Mission Drive to access the site. Also, the purpose of the right- of-way dedication for San Joaquin Drive along the eastern property boundary is to concur with the dedication of the subject street along the eastern frontage of the Palm Springs Classic project located to the immediate north. Currently,the subject property is vacant and therefore little or no usage of the roads, sidewalks and utilities is due to the subject property at this time. However, the future property owners will benefit from any improvements made to Gene Autry Trail, Mission Drive and San Joaquin Drive such as dedications of easements, sidewalks/bikepaths, and future widening. The required dedication of right-of-way and improvements will provide safety benefits to the property owners and will aesthetically enhance the neighborhood. Section 5: Pursuant to Government Code Section 66474.6, the City Council has determined that the discharge of waste from the proposed subdivision into the existing sewer system will not result in a violation of existing requirements prescribed by the Regional Water Quality Control Board; and NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby approves Tentative Parcel Map 29631 subject to those conditions set forth in the Attached Exhibit A, which are to be satisfied prior to the issuance of a Certificate of Occupancy unless otherwise specified. R19927 Page 6 RESOLUTION NO. 19927 EXHIBIT A TENTATIVE PARCEL MAP 29631 OCTOBER 18, 2000 CONDITIONS OF APPROVAL Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer, the Director of Planning, the Police Chief,the Fire Chief or their designee, depending on which department recommended the condition. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. PLANNING DIVISION: 1. The proposed subdivision and the future development thereof shall conform to all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any other City codes, ordinances and resolutions which supplement the zoning district regulations. 2. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Tentative Parcel Map 29631. The City of Palm Springs will promptly notify the applicant of any such claim, action or proceeding against the City of Palm Springs, and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or abandon a matter following an adverse judgement or failure to appeal, shall not cause a waiver of the indemnification rights herein. 3. Pursuant to Fish and Game Code Section 711.4 a filing fee of $78.00 is required. This project has a de minimus impact on fish and wildlife, and a Certificate of Fee Exemption shall be completed by the City and two copies filed with the County Clerk. This application shall not be final until such fee is paid and the Certificate of Fee Exemption is filed. Fee shall in the form of a money order or cashier's check payable to Riverside County. 4. The mitigation measures of the environmental assessment shall apply and are incorporated into these conditions by reference. 151+37 R19927 Page 7 5. Prior to issuance of a grading plan, a fugitive dust and erosion control plan shall be submitted and approved by the Building Official. Refer to Chapter 8.50 of the Municipal code for specific requirements. ' 6. The grading plan shall show the disposition of all cut and fill materials. Limits of site disturbance hall be shown and all disturbed areas shall be fully restored or landscaped. 7. Drainage swales shall be provided adjacent to all curbs and sidevvalks - 3 ft. wide and 6 inches deep. The irrigation system shall be field tested prior to final approval of the project. Section 14.24.020 of the Municipal Code prohibits nuisance water from entering the public streets, roadways or gutters. 8 Prior to issuance of a building permit, Fringe Toed Lizard Mitigation fees shall be submitted. 9 The applicant prior to issuance of any building permits within the subdivision shall submit a draft declaration of covenants, conditions and restrictions ("CC&R's") to the Director of Planning and Building for approval in a form to be approved by the City Attorney,to be recorded prior to issuance of occupancy permits. The CC&R's shall be enforceable by the City, shall not be amended without City approval, shall require maintenance of all property in a good condition and in accordance with all ordinances, and shall include provisions for maintenance of any private storm drain and/or sewer appurtenances, as applicable. The landscape strips and irrigation along San Joaquin Drive, Mission Drive and Gene Autry Trail shall be maintained by the Owners Association. Parameters for maintenance of perimeter landscaping and irrigation shall be specified in the CC&R's for the: Parcel Map, to ' the satisfaction of the City Attorney and the Director of Planning and Building. The applicant shall submit to the City of Palm Springs, a deposit in the amount of $ 2,000.00, for the review of the CC&R's by the City Attorney. 10. No direct vehicular access shall be allowed on to San Joaquin Drive; all vehicular access to the subdivision shall be from the internal street system, to the satisfaction of the Director of Planning and Building and the City Engineer. 11. A decorative masonry wall shall be constructed and landscaping provided along San Joaquin Drive in conjunction with any buildings within the subdivision. The final design of the decorative wall and landscaped areas shall be reviewed and approved by the Planning Commission as part of the applicable architectural approval application for development of the site. The referenced wall and landscaping shall be maintained by the property owners within the industrial subdivision, with maintenance provisions specified in the C,C&R's for the project, in a form acceptable to the City Attorney, and shall be installed in conjunction with Phase One development of the subdivision. 12 In an effort to minimize any potential short-term environmental impacts related to construction of the subdivision to downwind residents in the: Dream Homes subdivision, the developer shall implement all necessary blovvsand and dust control measures throughout all phases of development of the property, as ' specified in the Environmental Assessment for the subdivision, as well as constructing the east property line decorative wall with the initial phase of construction, as specified above. 13A36 R19927 Page 8 13. Landscaping of the common areas around the perimeter of the subdivision shall be completed in accordance with the previously prepared and adopted Design Guidelines supplement dated January, 1995, prepared by Tom Doczi and Associates and to the satisfaction of the Director of Planning and Building. If conflicts arise between the parameters of the Design Guidelines supplement and City Codes, then the applicable City Code(s) shall rule, as determined by the Director of Planning and Building. POLICE DEPARTMENT: 14. Developer shall comply with Section II of Chapter 8.04 of the Palm Springs Municipal Code. BUILDING DEPARTMENT: 15. Prior to any grading or construction on - site, all appropriate permits must be secured. FIRE DEPARTMENT: 16 Construction shall be in accordance with the 1998 California Fire Code, 1997 Uniform Fire Code, 1998 California Building Code, 1997 Uniform Building Code, 1996 National Electrical Code, City of Palm Springs Ordinance 1570, Desert water Agency requirements, NFPA standards including 13, 24, 71,72 760 plus UL and CSFM listings and approvals. 17. Fire Department access roads shall be provided and maintained in accordance with the 1998 California Fire Code, Article 9, Section 902. 18. Fire apparatus access roads shall have an unobstructed width of not less than 20 ft. and an unobstructed vertical clearance of not less than 14 ft. 6 inches in accordance with 1998 California Fire Code, Article 9, Section 902.2.2.1 and the City of Palm Springs Ordinance 1570. 19 Required marking of fire apparatus roads and fire protection equipment shall be in accordance with the 1998 California Fire Code, Article 9, Section 901.4. 20. Fire apparatus access roads shall be designed and constructed as all weather and able to support a fire truck weighing 67,000 pounds in accordance with 1998 California Fire Code, Article 9, Section 902.2.2.2 and City of palm Springs Ordinance 1570. 21. The turning radius of fire apparatus roads shall be at least 43 feet from centerline in accordance with 1998 California Fire Code, Article 9, Section 902. Par. 2.2.3. and City of Palm Springs Ordinance 1570. 22. Access road turn - around requirements for dead end fire apparatus roads in excess of 150 feet in length shall be provided with approved provisions for the turning around of fire apparatus. The approved turn-around provision is a cul-de- sac with a turning radius of 43 feet from centerline. Refer t 1998 California Fire Code Article 9, Section 902.2.4 and City of Palm Springs Ordinance 1570. 23. Cul - de- sac streets shall be designed with a minimum turning radius of 43 feet from centerline. Refer to 1998 California Fire Code Article 9, Section 902.2.2.4 and City of Palm Springs Ordinance 1570. 3 A 31 R19927 Page 9 24. Water supplies and fire hydrants shall be in accordance with 1998 California Fire Code, Article 9, Section 903.4, Appendix III-B and Desert Water Agency Specifications. ' 25. A commercial fire hydrant shall be installed every 300 feet or portion thereof. H-2 type fire hydrants are required. 26. Submit detailed plans for review as soon as possible. 27. Further comments may be forthcoming as conditions warrant. ENGINEERING DIVISION: The Engineering Division recommends that if this application is approved, such approval is subject to the following conditions being completed in compliance with City standards and ordinances: A. The developer shall submit an updated traffic study to the City Engineer prior to issuance of any permits for the proposed project. The study shall analyze both intersections of LOT A NORTH AND SOUTH @ GENE AUTRY TRAIL to determine if signal(s) are warranted. The recommendations of this study shall be incorporated into these conditions of approval. Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer. ' STREETS 1. Any improvements within the street right-of-way require a City of Palm Springs Encroachment Permit. Work shall be allowed according to Resolution 17950 - Restricting Street Work on Major and Secondary Thoroughfares. 2. Developer shall obtain State permits and approval of plans for all work done on State Highway 111 prior to the City of Palm Springs issuing any construction permits. 3. Submit street and sewer improvement plans prepared by a Registered Civil Engineer to the Engineering Division. The plan(s) shall be approved by the City Engineer prior to issuance of any grading or building permits. Minimum submittal shall include the following: A. Copy of signed Conditions of Approval from Planning Department. B. All agreements and improvement plans approved by City Engineer, IF applicable. C. Proof of processing dedications of right-of-way, easements, ' encroachment agreements/licenses, covenants, reimbursement agreements, etc. required by these conditions. 13 A 40 R19927 Page 10 GENE AUTRY TRAIL 4. Dedicate an additional right-of-way of 5 feet to provide the ultimate half street width of 55 feet along the entire Gene Autry Trail frontage of APN 677-270-011 perthe City of Palm Springs General Plan in accordance with City of Palm Springs Standard Drawing No. 105, 4A. Dedicate easements for the portions of the sidewalk, bicycle path and bus turn out that leave the public right-of-way. 5. Gene Autry Trail is a limited access highway. Driveway access to lots fronting on Gene Autry Trail shall be from Lot A (Unnamed Street). 5A. The developer shall comply with the Caltrans requirements as set forth in their letter dated June 26, 2000 and attached to the Environmental Assessment for the project. 6. The centerline of Lot A North and Lot A South shall align with the driveway centerlines on the west side of Gene Autry Trail. Developer shall be responsible for all modifications to the existing median cuts. 7. Construct the NORTH AND SOUTH halves of an 8 foot cross gutter and spandrel at the intersection of GENE AUTRY TRAIL and LOT A SOUTH INTERSECTION with a flow line parallel to the centerline of GENE AUTRY TRAIL in accordance with City of Palm Springs Standard Drawing Nos. 206 and 207. 8. Construct the NORTH AND SOUTH halves of an 8 foot cross gutter and spandrel at the intersection of GENE AUTRY TRAIL and LOT A NORTH INTERSECTION with a flow line parallel to the centerline of GENE AUTRY TRAIL in accordance with City of Palm Springs Standard Drawing Nos. 206 and 207. 9. Construct a 130-foot long by 12-foot wide bus turn out on the northeast corner of the intersection of Gene Autry Trail and the Million Air north driveway. The northeast curb return shall be recessed east 12 feet. The configuration shall be approved by the City Engineer in conjunction with SunLine Transit. Contact SunLine Transit for details regarding bus stop furniture/shelter requirements. Developer shall construct the shelter inclusive of furniture and lighting. 10. Construct a 10 foot wide Class I meandering bicycle path (Caltrans Design Manual, Chapter 1000 - Bikeway Planning and Design) along the entire frontage.The bicycle path shall be constructed of colored Portland cement concrete. The admixture shall be Desert Sand, Palm Springs Tan, or approved equal color by the Engineering Division. The concrete shall receive a broom finish. 11. Construct a ramp for the physically handicapped at the both sides of GENE AUTRY TRAIL AND LOT A NORTH AND LOT A SOUTH INTERSECTIONS of the subject property in accordance with City of Palm Springs Standard Drawing No. 212. 12. All broken or off grade CURB, GUTTER, AND AC PAVEMENT shall be repaired or replaced. 13 A 141 R19927 Page 11 13. If the public grant application for landscaping the Gene Autry Trail North median island is not granted during the 2000 calendar year, the developer shall pay his proportionate share of the landscape/irrigation construction of the landscaped, raised median island across the project frontage as ' specified by the City Engineer and Director of Planning and Building. MISSION DRIVE 14 Any improvements within the street right-of-way require a City of Palm Springs Encroachment Permit. 15. Construct a minimum 8 foot wide sidewalk behind the curb along the entire frontage in accordance with City of Palm Springs Standard Drawing No. 210. 16. Construct a ramp for the physically handicapped, using a 35 foot radius curb return, at the SOUTHWEST corner of the subject property in accordance with City of Palm Springs Standard Drawing No. 212. 17. All broken or off grade CURB, GUTTER, AND AC PAVEMENT shall be repaired or replaced. SAN JOAQUIN DRIVE 18. Any improvements within the street right-of-way require: a City of Palm Springs Encroachment Permit. , 19. Construct a 6 inch curb and gutter, 18 feet WEST of centerline along the entire frontage, with a 25 foot radius curb return at the SOUTHEAST corner of the subject property per City of Palm Springs Standard Drawing No. 200. 20. Construct a ramp for the physically handicapped at the SOUTHEAST corner of the subject property in accordance with City of Palm Springs Standard Drawing No. 212. 21. Construct a minimurn pavement section of 2-1/2 inch asphalt concrete pavement over 4 inch Class II aggregate base with a minimum subgrade of 24 inches at 95% relative compaction, OR equal,from edge of proposed gutter to centerline along the entire frontage in accordance with City of Palm Springs Standard Drawing No. 110 AND 300. The pavement section shall be designed, using "R" values, by a licensed Soils Engineer wind submitted to the City Engineer for approval. 22. Developer shall apply for the vacation of the west 15 feet of the existing 40 foot wide right-of-way easement on SAN JOAQUIN DRIVE from MISSION DRIVE to the NORTH PROPERTY LINE OF APN 677-270-011, exclusive of a property line - corner cut back at the SOUTHEAST corner of the subject property in accordance with the City of Palm Springs Standard ' Drawing No. 105, Developer shall be responsible for the final resolution of all utilities, demolition of all existing improvements, reconstruction of affected intersecting streets and coordination of improvements with adjacent property owners, if applicable, for the street vacation. All agreements and improvement plans relative to the above-mentioned items 13A 4� R19927 Page 12 shall be reviewed and approved by the City Engineer prior to the submittal of the street improvement plans. 23. There shall be no access to San Joaquin Drive from this project. Developer shall dedicate access rights on the Parcel Map to the City of Palm Springs. Said access rights shall be included in the Owner Statement and the City Clerk's Statement. LOT A 24. Any improvements within the street right-of-way require a City of Palm Springs Encroachment Permit. 25. Construct a 6 inch curb and gutter, per City of Palm Springs Standard Drawing No. 200A, 25 feet BOTH SIDES of centerline along the entire frontage, with a 35 foot radius curb return at the NORTH AND SOUTH INTERSECTIONS OF LOT A AND GENE AUTRY TRAIL of the subject property. 26. The driveway approaches shall be constructed in accordance with City of Palm Springs Standard Drawing No. 201 and have minimum widths of 24 feet. 27. Construct a minimum 8 foot wide sidewalk behind the curb along the entire frontage in accordance with City of Palm Springs Standard Drawing No. 210. 28. Construct both sides of a 6 foot cross gutter and spandrel at both of the intersections of Lot A and Lot C with a flow line parallel to the centerline of Lot A in accordance with City of Palm Springs Standard Drawing No. 200 and 206. 29. Construct a minimum pavement section of 3 inch asphalt concrete pavement over 6 inch crushed aggregate base with a minimum subgrade of 24 inches at 95%relative compaction, OR equal,from edge of proposed gutter to edge of proposed gutter in accordance with City of Palm Springs Standard Drawing No. 110 and 310. The pavement section shall be designed, using "R"values, by a licensed Soils Engineer and submitted to the City Engineer for approval. Use City of Palm Springs Standard Drawing No. 104 where applicable for a knuckle curve configuration. 29A. All curve radii shall be a minimum of 300 feet. LOT C 30. Any improvements within the street right-of-way require a City of Palm Springs Encroachment Permit. 31, Construct a 6 inch curb and gutter, per City of Palm Springs Standard Drawing No. 200A, 25 feet BOTH SIDES of centerline along the entire frontage, with a 35 foot radius curb return at the NORTH AND SOUTH INTERSECTIONS OF LOT A AND GENE AUTRY TRAIL of the subject property. 1 3 A T 3 R19927 Page 13 32. The driveway approaches shall be constructed in accordance with City of Palm Springs Standard Drawing No. 201 and have minimum widths of 24 feet. 33. Construct a minimum 8 foot wide sidewalk behind the curb along the entire ' frontage in accordance with City of Palm Springs Standard Drawing No. 210. 34. Connect all sanitary facilities to the City sewer system. 36. Construct sewer laterals from existing sewer main to a location in the proximity of the plumbing outlet of said property. Cap all laterals at right-cf- way line for future connection to City sewer system. 37. Developer shall construct an 8 inch sewer main across the entire LOT A ' frontage in accordance with the Master Plan of Sewers and connect to the existing sewer system on the west side of Gene Autry Trail. 38. All sewer mains constructed by the developer and to become part of the City sewer system shall be televised by the developer prior to acceptance of said lines. GRADING 39. Drainage swales shall be provided adjacent to all curbs and sidewalks- 3' wide and 6"deep-to keep nuisance waterfrom entering the public streets, roadways, or gutters. 40. In accordance with City of Palm Springs Municipal Code, Section 8.50.00, the developer shall post with the City a cash bond of two thousand dollars ($2,000.00) per acre for mitigation measures of erosion/blowsand relating to his property and development. 41. A soils report prepared by a licensed Soils Engineer shall be required for and incorporated as an integral part of the grading plan for the proposed site. A copy of the: soils report shall be submitted to the Building Department and to the Engineering Department along with plans, calculations and other information subject to approval by the City Engineer ' prior to the issuance of the grading permit. 42. Developer shall obtain a General Construction Activity Storm Water Permit from the State Water Resources Control Board (Phone: No. (916)-657- 0687) and provide a copy of same, when executed, to the City Engineer 1 ,3A y fq R19927 Page 14 prior to issuance of the grading permit. 43. Contact the Building Department to get PM10 requirements prior to request for grading permit. DRAINAGE 44. The developer shall accept all flows impinging upon his land and conduct these flows to an approved drainage structure. On-site retention/detention or other measures approved by the City Engineer shall be required perthe Hydrology Study. Provide calculations to determine if the developed Q exceeds the capacity of the approved drainage carriers. MAP 45. The Title Report prepared for subdivision guarantee for the subject property and the traverse closures for the existing parcel and all lots created therefrom shall be submitted with the Parcel Map to the Engineering Division. 46. The Title Report prepared for subdivision guarantee for the subject property and the traverse closures for the existing parcel and all areas of right-of-way or easement dedication shall be submitted to the City Engineer for review and approval with the Grant Deed. 47. The Parcel Map shall be prepared by a licensed Land Surveyor or qualified Civil Engineer and submitted to the Engineering Division for review. Submittal shall be made prior to issuance of grading or building permits. GENERAL 48. Any utility cuts in the existing off-site pavement made by this development shall receive trench replacement pavement to match existing pavement plus one additional inch. See City of Palm Springs Standard Drawing No. 404 modified to require the final 2 feet of subgrade to be compacted in lifts not to exceed 15 inches. Pavement shall be restored to a smooth rideable surface. 49. All existing utilities shall be shown on the street plans. The existing and proposed service laterals shall be shown from the main line to the property line.The approved original street plans shall be as-built and returned to the City of Palm Springs Engineering Division prior to issuance of the certificate of occupancy. 50. Developer shall contact all utility purveyors to obtain written confirmation of service and submit a copy of all utility company will-serve letters to the City Engineer with first plan check. 51. Nothing shall be constructed or planted in the corner cut-off area of any street intersection or driveway which does or will exceed thirty (30) inches in height in order to maintain an appropriate sight distance. 52. All trees within the public right-of-way and within 10 feet of the public sidewalk and/or curb shall have City approved deep root barriers installed per City of Palm Springs Engineering specifications. 115 q 1 y r R19927 Page 15 TRAFFIC 53. The developer shall provide a minimum of 48 inches of sidewalk clearance around all street furniture for handicap accessibility. The developer shall 1 provide same through dedication of additional right-of-way and widening of the sidewalk or shall be responsible for the relocation of all existing traffic signal/safety light poles, conduit, pull boxes and all appurtenances located on the GENE AUTRY TRAIL, MISSION DRIVE, LOT A and LOT C frontages of the subject property. 54 Separate striping plans are to be prepared and submitted along with street improvement plans for review and approval by the City Engineer. 55. The developer shall install a 5 phase traffic signal at GENE AUTRY TRAIL and LOT A NORTH and/or at GENE AUTRY TRAIL and ILOT A SOUTH if required by the traffic study. 56. Street name signs shall be required at each intersection in accordance with City of Palm Springs Standard Drawing Nos. 620 through 625. 57. If traffic signals are not required, a 30 inch "STOP" sign and standard "STOP BAR" and "STOP LEGEND" shall be installed per City of Palm Springs Standard Drawing Nos. 620-626 at the following !locations: GENE AUTRY TRAIL_ @ LOT A SOUTH GENE AUTRY TRAIL @ LOT A NORTH 58. Construction signing, lighting and barricading shall be provided for on all 1 projects as required by City Standards or as directed by the City Engineer As a minimum, all construction signing, lighting and barricading shall be in accordance with State of California, Department of Transportation, "MANUAL OF TRAFFIC CONTROLS FOR CONSTRUCTION AND MAINTENANCE WORK ZONES" dated 1996, or subsequent additions in force at the time of construction. 13 1
