RECOMMENDATION:
The Planning Commission recommends that the City Council approve the fifth 12-month
time extension from October 19, 2000 to October 19, 2001, for the Palm Springs Classic
Preliminary Planned Development District(PD 231)and third time extension of TTM 28033,
subject to the original conditions of approval. The subject property is located at the
southeast corner of Vista Chino and Gene Autry Trail (Highway 111). Representing D.T.
Continental Golf Center Enterprises is Steven Mitchell, Vice-President. Mainiero, Smith &
Associates has prepared improvement plans for the project. DT Palm Springs has entered
into an agreement with Tuchscher Development Enterprises, and William C. Tuchscher
represents Palm Springs Leisure Properties, the new LLC which has been created.
BACKGROUND:
The City has received an application by D.T. Palm Springs Inter-Continental Golf Center
Enterprises, Ltd.for approval of the third time extension of TTM 28033 and approval of the
fifth 12-month time extension for a Planned Development District composed of up to a 400
-room hotel, up to 500 two-bedroom Vacation Ownership Units (VDU's), research and
development facilities, commercial/retail and light industrial uses, a tennis complex, a 27-
hole golf course and golf clubhouse on approximately 369.5 acres.
The projectwas recommended for approval at the October 12, 1994, Planning Commission
meeting and was approved at the October 19, 1994, City Council meeting with a two-year
time frame. The City Council approved the four time extensions. Thus, the applicant is
requesting approval of the fifth time extension of PD 231, which would expire October 19,
2001.
The tentative tract map for the site was recommended for approval at the July 26, 1995
Planning Commission meeting. The map was then approved at the September6, 1995 City
Council meeting. The map would have expired on September6, 1997; however,as a result
of AB771 -Chapter46 of the 1996 State Statutes, one additional year was provided for the
map. A second time extension of TTM 28033 was approved on November 10, 1999. This
extension was granted for a period of 13 months in order to synchronize the TTM and PD
approvals; so if the time extension request is approved, the map will expire October 19,
2001.

At this time, the applicant indicates the extension is required to revise the entitlements to
create a project that is more sensitive to current and projected market trends and to secure
financing for the development. A new LLC has been created, Palm Springs Leisure
Properties,which will re-entitle and develop the project. The land use program is currently
being re-planned by Gensler and Associates, in coordination with P&D Consultants and
Mainiero Smith, and the applicant hopes to have a revised land plan for staff review in the
next month. By approving the subject time extension,the City Council would keep existing
permits active and allow the Certified Environmental Impact Report to remain in place.
PLANNING COMMISSION ACTION:
At its meeting of September 13,2000, the Planning Commission voted 6-0(Caffery absent)
to recommend that the City Council grant the requested time extensions, subject to the
original conditions of approval.

Dear Mr. Mitchell:
On December 15, 1999, the City Council considered a time extension for Tentative Tract Map 28033 and
Planned Development District 231,which brought about discussion of the status of the Palm Springs Classic.
The Council expressed concerns that there has been no progress in moving this project forward. In originally
approving the project,the City Council and the property owners committed that this undertaking would move
forward and revitalize our community. All approvals are in place and the economy is strong;however,we have
not seen or heard of any progress on this project. 6
The City Council has asked me to convey its disappointment about the lack of progress and has expressed the
• thought that future time extensions should not be granted. I personally believe that the development of a
destination resort is a viable land use for this property, but question why a fully entitled project with no
environmental problems cannot be developed. The City Council has watched the development of numerous
other projects in the Coachella Valley- many of which have similar land use components and on sites that are
comparable to the Palm Springs Classic location.
Planning staff has given you an update on pending issues which could place current entitlements in question.
The City desires to see this project completed but at this time the City Council is not sure that the property
owners are committed to developing this site. If they are not, then the City Council would rather see the
property put to alternative land uses.
We look forward to your client's response to the City Council's concerns. Additionally, the City would like
to know if it can assist in moving this project forward.

Dear Mr. Evans:
This letter is to formally request a one-year extension for the Tentative Tract Map #28033 and
Planned Development District 231 for the Palm Spring Classic Project, which will expire October
19, 2000. Enclosed is a check for$550.00 for the processing fee.
DT Palm Springs has been working to realize the Palm Springs Classic Project for several years,
during this time market conditions have changed. The extension is required to revise the
entitlements to create a project that is more sensitive to current and projected market trends and to
secure financing for the development.
DT Palm Springs has entered into an agreement with Tuchscher Development Enterprises. A
new LLC has been created,Palm Springs Leisure Properties (PSLP),which will re-entitle and
develop the Palm Springs Classic Project. The project team consists of William Tuchscher, CEO,
and acting Vice Presidents Debra DePratti, Development, and Ken Feenstra, Community and
Government Relations. Together with staff we plan to move this project forward in an
expeditious manner.
The land use program is currently being re-planned by Gensler, in coordination with P&D
Consultants, and Mainlero Smith. We hope to have a revised land plan for staff review in the
next month.

SUPPLEMENTAL AGENDA:
Tentative Tract Map 28033—Application by DT Palm Springs (Palm Springs Classic) —Case
5.0666 — PD 213 for the third time extension from September 06, 2000 to October 19, 2001 for
a Tentative Tract Map to subdivide 369.5 acres into Vista Chino; W-M-1-P and 0-5 Zones,
Sections 7 and 18.
Principal Planner Hayes reported that this time extension request is due to a new agreement
having been created with Tuchscher Development Enterprises, improvements being
researched for the plans to reflect current market trends, and in order for the applicant to
secure financing. He stated that, if approved, this would be the fifth time extension for the
Planned Development District.
Director reported that there would likely be amendments to existing plans and that both Mr.
William Tuchschner and Mr. Ken Feenstra were available to answer questions for the Planning
Commission.
Mr. Ken Feenstra addressed the Planning Commission to introduce Mr. Tuchschner of Leisure
Development Properties — a master planned community developer.
Mr. Tuchschner reported that Mr. Feenstra will serve as the Vice President of Community ����
Relations, that Ms. Debra Duprati is working on the project, and that Mainiero, Smith, &

Associates is also working on the project. Mr. Tuchschner reported that his company has a
long-term interest in the community, that he would like to be an active member of the
community, and that his intention is to create a new landmark development for the City.

duly noticed meeting of September 13, 2000; and
WHEREAS,the Planning Commission reviewed all evidence provided, including the staff
report dated September 13, 2000 and all other written and oral testimony, and found the
Project,subject to the original conditions of approval,consistentwith the requirements of the
ordinances of the City and with State law; and
WHEREAS, notice of a public meeting of the City Council of the City of Palm Springs to
consider Applicant's application fora third time extension from October 19,2000to October
19,2001 forTTM 28033 and fifth 12-month time extension from October 19,2000 to October
19, 2001 for PD 231 was given in accordance with applicable law; and
WHEREAS, the City Council has independently reviewed all evidence provided, including
the staff report dated October4, 2000 and all otherwritten and oral testimony, and finds th

NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs,

approval of the third time extension for the tentative tract map to October 19, 2001 and fifth
12-month time extension for the planned development to October 19, 2001.
