SPRINGS, CALIFORNIA, UPHOLDING THE
PLANNING COMMISSION'S DECISION
CONCERNING THE DENIAL OF A REQUEST TO
' CHANGE THE FINISH ROOF MATERIAL FROM
A TWO-PIECE CLAY BARREL TILE TO A
CEMENT`S"TILE,PERTAINING TO CASE 3.1653
FOR A NEW SINGLE FAMILY RESIDENCE
LOCATED AT 590 CAMINO CALIDAD,SECTION
22.
WHEREAS,Simeon Grey("Appellant")filed Architectural Application 3.1653 with the City of Palm
Springs pursuant to Section 9404.00 of the Zoning Ordinance for a hillside single family residence
located at 590 Camino Calidad, R-1-A Zone, Section 22; and
WHEREAS, on September 25, 1998, the application was administratively approved by the City
Planning Division in accordance with applicable law; and
WHEREAS,the application proposed the use of two-piece clay barrel tile as the finish roof material
and was approved by staff; and
WHEREAS,public meetings of the Planning Commission were held on May 12 and May 26, 1999
to consider the Planning Division's decision to deny the request to change the finish roof material,
and notice of said meetings was given in accordance with applicable law.
WHEREAS, after reviewing the staff report and listening to public testimony and review of the
Appellant proposal,the Planning Commission voted(by a vote of 5 to 2)to uphold the earlier staff s
determination to construct the residential structure utilizing the two-piece clay barrel tile as originally
approved; and
WHEREAS,on June 3, 1999, the City Clerk received a letter of appeal to the City Council from the
Appellant requesting appeal of the Planning Commission's decision disallowing the request by the
Appellant to substitute the previously approved two-piece clay barrel the to cement"S" tile; and
WHEREAS,Notice of the Hearing of the City Council of the City of Palm Springs to consider the
appeal of the Planning Commission's decision to deny the request to change the finish roof material
was given in accordance with applicable law; and
WHEREAS, on June 16, 1999, a public hearing on the subject appeal was held by the City Council
in accordance with applicable law; and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented
in conjunction with the hearing of the appeal, including, but not limited to, the staff report, and all
written and oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to Zoning Ordinance Section 9320.00, the City Council finds that:
a. Administrative approval of architectural applications for single family residences is proper
subject for review by Planning Commission,as per Section 9404.00 of the Zoning Ordinance.
b. That said proposal by the Appellant to substitute the use of concrete roof tile material instead

the two-piece clay barrel file as originally proposed by the Appellant, is not desirable for
the development of the neighborhood, is not in harmony with the neighborhood, and is not
consistent with the design of the proposed residence.
C. That said proposal to use concrete tile would be aesthetically detrimental to existing and
future uses and development of surrounding properties within the vicinity of the subject
property. ,
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing,the City Council hereby
upholds the Planning Commission decision to disallow a change of finish roofing material from two-
piece clay barrel tile to concrete"S"the for the property located at 590 Camino Calidad, and directs
the Appellant to use a two-piece clay barrel tile in construction of the roof.
