HomeMy WebLinkAbout19492 - RESOLUTIONS - 4/7/1999 RESOLUTION NO. 19492 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING, SUBJECT TO THE CONDITIONS STATED, CASE NO. 3.1716, AN APPLICATION BY MORRIS COMMUNICATIONS ' CORPORATION FOR A TELECOMMUNICATIONS ANTENNA, CONSISTING OF A 60-FOOT TALL MONOPOLE WITH FOUR 6-FOOT DIAMETER RADIO TRANSMITTING ANTENNAE AND TWO 4-FOOT RADIO TRANSMITTING ANTENNAE LOCATED AT THE SOUTHWEST CORNER OF GENE AUTRY TRAIL AND CHIA ROAD, M-1-P ZONE, SECTION 13. ------------- WHEREAS, Morris Communications Corporation, (the "applicant") has filed an application with the City pursuant to Section 9404.00 of the Zoning Ordinance for Architectural Approval Case No. 3.1716 for a proposed telecommunications antenna, consisting of a 60-foot tall monopole with four six-foot diameter radio transmitting antennae and two four-foot radio transmitting antennae loacted at the southwest corner of Gene Autry Trail and Chia Road, M-1-P Zone, Section 13; and WHEREAS, the applicant is requesting that the City Council take action on the proposed application to allow the applicant to remedy outstanding financial contracts or issues associated with the purchase of the site in question; and WHEREAS, on March 3, 1999, the Airport Commission reviewed this item, which at the time was proposed as an 80-foot tall structure, and recommended that the proponent be required to maintain obstruction lighting on the tower and that the tower be of the lowest possible height; and WHEREAS, since the time of the Airport Commission meeting on March 3, 1999, the applicant has reduced the height of the structure to its currently proposed overall height of 60 feet; and WHEREAS, the applicant will be removing a number of communications antennae from the roof of the two-story building located at the northeast corner of Ramon Road and Farrell Drive with the relocation of the facility to the proposed site; and WHEREAS, the City Council of the City of Palm Springs reviewed the application at their April 7, 1999 meeting in accordance with applicable law; and WHEREAS, the proposed application is categorically exempt pursuant to the terms of the California Environmental Quality Act(CEQA) per Section 15303 (New Construction and Conversion of Small Structures); and ' WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the project, including, but not limited to the staff report and all written and oral testimony presented. 17V R19492 Page 2 467� THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: A y/J Section 1: Pursuant to CEQA, the City Council finds as follows: The project is categorically exempt from the requirements of CEQA pursuant to Section 15303 (New Construction and Conversion of Small Structures) of the CEQA guidelines. , Section 2: Pursuant to Zoning Ordinance Section 9404.00, the City Council finds that, with the Conditions of Approval incorporated herein by reference, the proposed application will not have a significant negative detrimental aesthetic impact on the community and is not detrimental to existing uses or to future uses specifically permitted with this zone or with uses and or zoning designations in the immediate area in which the proposed is to be located. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the: City Council hereby approves Case No. 3.1716, subject to those conditions set forth in Exhibit A, on file in the office of the City Clerk, which are to be satisfied prior to recordation of a final map or the issuance of a Certificate of Occupancy, unless other specified.
