OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING AN AMENDMENT TO THE
LAND USE ELEMENT OF THE GENERAL PLAN TO
' REALIGN A PORTION OF A BIKE TRAIL WEST OF THE
TACHEVAH DAM LOCATED IN SECTION 9, 10 AND 15.
WHEREAS, the City of Palm Springs, (the "Applicant") has filed an application to amend the
Land Use Element of the General Plan to realign a portion of a bike trail located west of the
Tachevah Dam adjacent to the San Jacinto Mountains; and
WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm Springs to
consider the City's application for a General Plan Amendment was given in accordance with
applicable law; and
WHEREAS, on October 14, 1998, a public hearing on the General Plan Amendment application
was held by the Planning Commission in accordance with applicable law; and
WHEREAS, at the conclusion of its public hearing on October 14, 1998, the Planning Commission
adopted Resolution No. 4609a, recommending that the City Council approve the General Plan
Amendment, subject to the findings in Resolution No. 4609a; and
WHEREAS, notice of a public hearing of the City Council of the City of Palm Springs to consider
the City's application for a General Plan Amendment was given in accordance with applicable law;
and
WHEREAS, on November 18, 1998, a public hearing on the General Plan Amendment application
was held by the City Council in accordance with applicable law; and
WHEREAS, the City has determined that the bike trail is not feasible or necessary at this location
because linkage to the north and south must occur across, rugged, steep, dangerous slopes and may
conflict with existing equestrian trails; and,
WHEREAS, the bike trail is proposed to link up into the existing Las Palmas neighborhood bike
route; and,
WHEREAS, the proposed General Plan Amendment is consistent with all General Plan objectives
and policies; and,
WHEREAS, this revision was considered in the Final Environmental Impact Report (EIR) prepared
for the Mountain Falls Golf Preserve. The Final EIR includes the Draft EIR, comments and
responses to the Draft EIR, Planning Commission public hearing minutes, Notice of
Preparation comments, local golf course trip generation study, U.S. Fish & Wildlife Service,
' Bighorn Institute and California Department of Fish & Game correspondence, Palm Springs
Unified School District correspondence and other miscellaneous correspondence; and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented
in connection with the hearing on the Project, including but not limited to the staff report, all Y<
environmental data including the initial study, the Final Environmental Impact Report and all 7
written and oral testimony presented.

THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds as follows:
This revision was considered in the Final Environmental Impact Report prepared for the
Mountain Falls Golf Preserve. The Final Environmental Impact Report was completed in
compliance with CEQA, the State CEQA Guidelines and the City's CEQA procedures. The
City Council has independently reviewed and considered the information contained in the
Final Environmental Impact Report and finds that it adequately discusses effects of the
proposed General Plan Amendment and that, on the basis of the Environmental Impact
Report and comments received during the public review process, there is no substantial
evidence that there will be a significant adverse environmental effect as a result of the
General Plan Amendment.
Section 2:
This proposed revision of the General Plan to realign a portion of a bike trail located west
of the Tachevah Dam adjacent to the San Jacinto Mountains will allow the General Plan to
remain internally consistent.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council
' hereby approves the realignment of a portion of a bike trail located west of the Tachevah Dam
adjacent to the San Jacinto Mountains as shown on Exhibit "A".
ADOPTED this 16thday of Decemhar , 1998.
