OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING AN AMENDMENT TO THE
LAND USE ELEMENT OF THE GENERAL PLAN FROM L4
' (LOW RESIDENTIAL - 4 UNITS PER ACRE) TO L6 (LOW
RESIDENTIAL - 6 UNITS PER ACRE) SUBJECT TO
CONDITIONS STATED, FOR PROPERTY LOCATED AT THE
NORTHWEST CORNER OF CALLE AMIGOS AND E.
SUNNY DUNES, R-1-C ZONE, SECTION 23.
WHEREAS, Dennis Cunningham, (the "Applicant") has filed an application with the City to
amend the Land Use Element of the General Plan from L4 (low Residential 4 units per acre) to
L6 (Low Residential - 6 units per acre) for property located at the northwest corner of Calle
Amigos and E. Sunny Dunes (the "Project"), R-1-C Zone, Section 23; and
WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm Springs
to consider Applicant's application for a General Plan Amendment was given in accordance with
applicable law; and
WHEREAS, at the conclusion of its public hearing on October 14, 1998, the Planning
Commision adopted Resolution No. 4608a, recommending that the City Council approve a
General Plan Amendment, subject to the findings and conditions stated in Resolution No. 4608a;
and
' WHEREAS, notice of a public hearing of the City Council of the City of Palm Springs to
consider the General Plan Amendment, was given in accordance with applicable law; and
WHEREAS, on November 18, 1998, a public hearing on the General Plan Amendment
application was held by the City Council in accordance with applicable law; and
WHEREAS, the General Plan Amendment will allow a unique Planned Development District
which entails a twelve lot residential subdivision on 2.32 acres that will provide a buffer between
the M15 (Medium Residential - 15 units per acre) property to the north and surrounding low
residential property; and,
WHEREAS, the proposed General Plan Amendment is consistent with all General Plan
objectives and policies; and,
WHEREAS, an environmental assessment was prepared for the project and is in compliance with
the California Environmental Quality Act ("CEQA"), and a Mitigated Negative Declaration has
been prepared for this project and has been distributed for public review and comment in
accordance with CEQA; and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence
presented in connection with the hearing on the Project, including but not limited to the staff
report, all environmental data including the initial study, the proposed Mitigated Negative
Declaration and all written and oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds as follows:
The final Mitigated Negative Declaration has been completed in compliance with CEQA,
the State CEQA Guidelines, and the City's CEQA procedures contained in the City's

CEQA Guidelines. The City Council has independently reviewed and considered the
information contained in the Mitigated Negative Declaration and finds that it adequately
discusses the significant environmental effects of the proposed Project, and that, on the
basis of the initial study and comments received during the public review process, there is
no substantial evidence that there will be any significant adverse: environmental effects as
a result of the approval of this Project. The City Council further finds that the Mitigated
Negative Declaration reflects its independent judgment. '
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council
hereby approves an amendment to the General Plan from IA (Low Residential - 4 units per acre)
to L6 (Low Residential 6 units per acre) for property at the northwest corner of Calle Amigos
and Sunny Dunes as shown in Exhibit A which is on file in the City Clerk's Office.
