OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS
PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION
37421 ET. SEQ. FOR THE SALE OF CITY PROPERTY NEAR
THE CORNER OF SUNRISE WAY AND SAN RAFAEL ROAD
' WHEREAS, the City is desirous of selling certain propertylocated in the City of Palm Springs "Sale
$' (
Property"), and located near San Rafael Road and Sunrise Way, in accordance with Government Code
Section 37420 et SeMc.;
WHEREAS, the City Council of the City of Palm Springs is informed that Burnett Development
Corporation, a California Corporation ("Burnett") owning property immediately abutting the Sale
Property, has applied to the City for the purchase the Sale Property;
WHEREAS, the City finds that there is no present or anticipated future use of the Sale Property for
public purposes, and that the Sale Property is landlocked between private property;
WHEREAS, the sale of the Sale Properly is consistent with the City's General Plan;
WHEREAS, the City has performed an informal appraisal of the Sale Property, through the services of
three local real estate brokers, and is satisfied that the reports provide a reasonably accurate assessment
of the fair market value of the Sale Property for$5,000;
WHEREAS, the City has published notice of the public hearing for November 4, 1998 at 7 p.m. for
consideration of the sale of the Sale Property, pursuant to California Government Code Sections
' 37421, 37422 and 37423,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows:
Section 1. The City hereby finds that the sale of the City-owned property near San Rafael Road
and Sunrise Way and more specifically described in the Legal Description of the
property, to an owner of property immediately abutting the Sale Property, is in the
public interest because the Sale Property is landlocked and there is no present or
anticipated future use of the Sale Property.
Section 2. The City hereby finds that the sale of the Sale Property for the collective amount of
$5,000 is in the public interest and represents the fair market value of the Sale
Property.
Section 3. The City hereby finds that no protest was made pursuant to California Government
Code Section 37425 for the sale of the Sale Property, or any protest made pursuant to
Section 37425 was overruled by four-fifths vote of the members of the City Council.

Section 4. The City Manager is authorized to execute the sale of the Sale Property pursuant to
this Resolution, passed by at least four-fifths vote of the City Council, in accordance
with California Government Code Section 37426.
