OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, TO APPROVE SUPPLEMENT NO. 5, AN AMENDMENT
TO THE LAND USE CONTRACT BETWEEN THE CITY OF PALM
SPRINGS AND THE AGUA CALIENTE BAND OF CAHUILLA INDIANS
(AGREEMENT NO. 1324) REMOVING ALL EXISTING AND FUTURE
LANDS ACQUIRED BY THE TRIBE.
WHEREAS, on July 26, 1977, the Agua Caliente Band of Cahuilla Indians, a federally recognised Indian tribe
(the Tribe), and the City of Palm Springs, a municipal corporation under the laws of the State of California (the
City), entered into a land use contract (the Land Use Contract) concerning the manner in which the, City would act
as the Tribe's agent for the enforcement of Tribal land use measures on all of the trust lands of the Agua Caliente
Indian Reservation located within the city limits of the City of Palm Springs. Subsequently, the. Tribe and the
City have executed Supplement Nos., 1, 2, 3 and 4 to the Land Use Contract. The Assistant Secretary of the
Interior for Indian Affairs duly approved this Land Use Contract with the first two supplements on May 18, 1987
and the Tribal Council duly approved the third and fourth supplements on December 22, 1994 and August 2,
1995, respectively; and
WHEREAS, the Tribe and the City desire to modify the Land Use Contract and effective upon the execution of
this Supplement No. 5 by the authorized representatives of both the Tribe and the City, the original Land Use
Contract shall be amended by the addition of Supplement No. 5, as on file in the Office of the City Clerk.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, California, as
follows:
Section 1. Supplement No. 5 to the Land Use Contract between the City of Palm Springs and the Agua
Caliente Band of Cahuilla Indians, exempting certain parcels from the terms of the Land Use
Contract which now are, or in the future will be, acquired by the Tribe within the city limits of
the City of Palm Springs, is hereby approved.
Section 2. The City Manager and the City Clerk are hereby authorized to execute the said supplement No.
5 to the Land Use Contract on behalf of the City of Palm Springs.
