OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING TENTATIVE PARCEL MAP
28918 FOR THE SUBDIVISION OF A SINGLE PARCEL OF
LAND INTO FOUR SEPARATE LOTS, THE PROPERTY
' BEING BOUNDED BY TAHQUITZ CANYON, FARRELL
DRIVE, BARISTO ROAD, AND THE EXTENSION OF
SUNSET WAY, CSC ZONE SECTION 13.
WHEREAS, the Lamar Companies (the "applicant') have filed an application with the City
pursuant to Section 9402.00 of the Zoning Ordinance and the Palm Springs Municipal
Code Section 9.62.010 for a Tentative Parcel Map to allow the subdivision of a single
parcel of land into four separate lots, the property being bounded by Tahquitz Canyon
Drive, Farrell Drive, Baristo Road, and the extension of Sunset Way, CSC Zone, Section
13.
WHEREAS, Notice of a public hearing of the Planning Commission of the City of Palm
Springs to consider the applicants request for Tentative Parcel Map 28918 was given in
accordance with applicable law; and
WHEREAS, on September 9, 1998, a Public Hearing on the application for Tentative
Parcel Map 28918 was held by the Planning Commission and at this hearing, the
Planning Commission recommended to the City Council approval of said Tentative Parcel
Map; and
' WHEREAS, the subdivision of this parcel of land is intended to enhance the marketability
of the mall by facilitating the leasing and or selling of the new pad sites; and
WHEREAS, notice of a public hearing of the City Council of the City of Palm Springs to
consider the subject application for a Tentative Parcel map was given in accordance with
applicable law; and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence
presented in connection with the hearing on the project, including but not limited to the
staff report.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds as follows
The tentative parcel map application is categorically exempt from an environmental
assessment per Section 15315 of the California Environmental Quality Act
(CEQA). Section 15315 states that the subdivision of four or fewer parcels is
exempt from CEQA.
Section 2: Pursuant to City of Palm Springs Municipal Code 9.62.010 and
Government Code Section 66747, the City Council finds that with the
incorporation of those conditions attached as Exhibit A:
a. The design and improvements of the proposed subdivision are consistent
with the General Plan. 0� A

The proposed Tentative Parcel Map complies with all the goals and policies
of the General Plan. The minor improvements such as right-of-way
dedications and constructions of two bus turn -outs with shelters will provide
for safety of the riders and enhance the overall streetscape for the project.
b. The site is physically suitable for the type of development contemplated by '
the proposed subdivision and is not detrimental to existing uses or to future
uses specifically permitted in the zone in which the proposed use is to be
located.
The project complies with all development standards pursuant to the
requirements of the Zoning Ordinance. Furthermore, the project site is
bounded by existing roadways that have been despgned and improved to
handle the increase in vehicle trips. The improvements such as the bus
turn -out on Farrell Drive is being relocated southerly to alleviate possible
traffic conflicts due to the proximity of the intersection.
C. The site for the intended subdivision is adequate in size and shape,
required in order to permit future uses of the land in the neighborhood.
The Palm Springs Mall contains a total of 26.2 acres. The proposed
subdivision creates four separate parcels ranging from .84 acres to 1.32
acres. The applicants anticipate that future uses in these parcels will service
the general commercial needs of the permanent residents of the area as
is stated in an objective of the Commercial Shopping Center land use
designation of the General Plan. To the extent possible, the developer will I
use existing improvements such as driveways, parking areas etc. to
eliminate potential impacts.
d. The design of the subdivision or improvements is not likely to cause
substantial environmental damage or substantially .and unavoidably injure
fish or wildlife or their habitat.
The design of the subdivision should have no environmental impact on
fish or wildlife or their habitat. The subdivision of land is being proposed
on a parcel that is currently developed and the improvements have
existed since 1958.
e. The conditions to be imposed and shown on the approved site plan are
deemed necessary to protect the public health, safety and general welfare,
including any minor modifications of the zone's property development
standards.
All proposed conditions of approval are necessary to ensure public welfare
health and safety.
Section 3: Pursuant to Government Code Section 66473.5, the City Council '
finds that the; proposed subdivision and the provisions for its design
and improvement are compatible with the objectives, policies and
general land uses and programs provided in the City's General Plan.
a. A nexus " and rough proportionality have . been established for the
requirement of the right-of-way dedications on Farrell Drive and Baristo
Road such that the existing and future traffic volumes, as a result of the

future development of the free-standing pads, will be adequately served by
the existing street improvements. Furthermore, a nexus has been
established for the requirement of two bus turn -outs with shelters; one on
Farrell Drive and the second on Baristo Road.
The right-of-way dedications which are being required on Farrell Drive and
' Baristo Road are related to the project due to future development expected
on the free-standing pads. Furthermore, the right-of-way dedications should
not physically affect existing private improvements since the street
improvements on both streets are at ultimate locations. Having these
streets at ultimate widths should adequately accommodate existing and
future traffic volumes. The addition of the bus turn -outs and shelters is part
of a program that the City and SunLine are jointly working to complete. The
two new stops and shelters will provide superior locations to accommodate
the increased ridership in the area and improve vehicular and pedestrian
safety.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council
hereby approves Tentative Parcel map 28918 subject to those conditions set forth in
Exhibit A, which are which are on file at the office of the City Clerk and which have to be
satisfied prior to the issuance of a Certificate of Occupancy unless otherwise specified.
