HomeMy WebLinkAbout19367 - RESOLUTIONS - 10/7/1998RESOLUTION NO. 19367 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING, SUBJECT TO THE CONDITIONS STATED, CASE NO. 5.0626-PD- ' 226/TTM 27674, TO GOLDRICH AND KEST FOR A REVISED PLANNED DEVELOPMENT DISTRICT TO AMEND THE ORIGINAL CONDITIONS OF APPROVAL FOR AN 148-UNIT CONDOMINIUM PROJECT (SANDSTONE VILLAS CONDOMINIUMS) ON 7.03 ACRES LOCATED AT 1900-1950 SOUTH PALM CANYON DRIVE, R-2 ZONE, SECTION 26. WHEREAS, Goldrich and Kest Industries, (the "applicant") has filed an application with the City pursuant to Section 9403.00 of the Zoning Ordinance for a Revised Planned Development District (PD) for the purpose of amending the original conditions of approval adopted by the City Council on February 17, 1993 for an existing 148-unit condominium project (Sandstone Villas Condominiums) at 1900-1950 South Palm Canyon Drive, R-2 Zone, Section 26; and WHEREAS, notice of public hearing of the Planning Commission of the City of Palm Springs to consider Applicant's application for a Revised PD for Case No. 5.0626-PD 226/TTM 27674 was given in accordance with applicable law; and WHEREAS, on August 26, 1998, a public hearing on the application for the Revised PD for Case No. 5.0626-PD-226/TTM 27674 was held by the Planning Commission in accordance with applicable law; and WHEREAS, the Planning Commission voted to recommend approval (4-1, one absent, one abstention) of the revised PD to amend condition of approval no. 14, as contained in Resolution No. 4600; and WHEREAS, notice of public hearing of the City Council of the City of Palm Springs to consider applicant's application for the Revised PD for Case No. 5.0626-PD-226/TTM 27674 to amend an original condition of approval was given in accordance with applicable law; and WHEREAS, the proposed Revised PD is considered exempt from the provisions of the California Environmental Quality Act (CEQA) per Section 15301 (Existing Structures); and WHEREAS, on Oxtober 7, 1998, a public hearing on the application for the Revised PD for Case No. 5.0626-PD-226/TTM 27674 was held by the City Council in ' accordance with applicable law; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including, but not limited to the staff report, and all written and oral testimony presented. R19367 Page 2 I c THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 17 Pursuant to CEQA, the City Council finds as follows: With the mitigation measures identified in the Negative Declaration adopted at the time of the condominium conversion, all potential significant environmental impacts will be mitigated to a point where clearly no significant environmental effects will as a result of the project. The mitigation measures adopted were originally identified as conditions of approval. Section 2: The City Council further finds that the revisions to the original conditions of approval for Case No. 5.0626-PD-226 is appropriate for consideration ,given the General Plan's Housing Element Goals and Objectives for providing affordable housing within the community and is adequate to achieve said goals and objectives. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby approves the revised PD to amend the original conditions of approval for Case No. 5.0626-PD-226/TTM 27674 as set forth in Exhibit A, (with revised Condition No. 14 as highlighted in bold) on file in the Office of the Ciry Clerk, which are to be satisfied as specified.
