HomeMy WebLinkAbout19366 - RESOLUTIONS - 9/21/1998 RESOLUTION NO. 19366 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, ' CALIFORNIA, APPROVING A QUIT CLAIM OF COVENANT AND NOT ACCEPTING IRREVOCABLE OFFER OF DEDICATION FOR STREET RIGHT-OF-WAY ON CALLE PALO FIERRO - SAHARA MOBILE HOME PARK WHEREAS, in June of 1963, Sahara Park, a California corporation, executed a covenant running with the land that provided for the use of a certain area of land on Calle Palo Fierro for trailer park purposes until such time as the City of Palm Springs desired to widen Calle Palo Fierro; and WHEREAS, the legal description that accompanied said covenant, contained errors such that it did not conclusively refer to a 30 foot wide strip of land adjacent to Calle Palo Fierro along the frontage of the Sahara Mobile Home Park property; and WHEREAS, National Horne Communities is presently investigating the feasibility of acquiring this property and wishes to have this matter corrected; and WHEREAS, the current property owners have executed a document irrevocably ' offering to dedicate said 30 foot strip of land to the City. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: 1. The City acknowledges receipt of the offer of dedication at this time, which, under the provisions of the Subdivision Map Act (Section 66477.2), can be accepted by the City at any future time. 2. The City Council authorizes execution of a document quit claiming a portion of the rights the City currently has under the 1963 covenant. ADOPTED this2lst day of September 1998.
