OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING A NEW AUTO
RENTAL FACILITY WITH CARWASH AS
SUBMITTED BY ENTERPRISE RENT-A-CAR FOR ,
THE PROPERTY LOCATED AT 4040 AIRPORT
CENTER DRIVE, M-1 ZONE, SECTION 18.
WHEREAS, Enterprise Rent-a-Car submitted a request for approval for a new auto rental
facility with a carwash for the property located at 4040 Airport Center Drive; and
WHEREAS, the application proposes the construction of a 2,148 sq.ft. building with a
1,665 sq.ft. carwash; and
WHEREAS, on July 22, 1998, by a 6-0-1 ( Mr. Fontana absent) vote, the Planning
Commission approved the proposed project subject to conditions; and
WHEREAS, the City Council is being asked to adopt a Resolution approving the
proposed new auto rental facility with a carwash; and
WHEREAS, the City Council has carefully reviewed and considered all of the evidence
presented in connection with the project, including but not limited to the staff' report, and
the recommendation of the Planning Commission.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds as follows:
a. The subject property was previously assessed under Case 5.0439-PD 189. The
Environmental Assessment properly analyzed all the potential impacts pursuant to
the California Environmental Quality Act (CEQA), and the use being proposed is
compatible with the uses discussed under said environmental assessment.
b. Pursuant to Fish and Game Code Section 711.4, this project has a de minimis
impact on fish and wildlife.
Section 2: Pursuant to Section 9402.00 of the Zoning Ordinance the City
Council finds that:
a. That the use applied for at the location set forth in the application is authorized by
the City's Zoning Ordinance (subject to a conditional use permit) and the Palm
Springs Municipal Code.
Pursuant to the Zoning Ordinance, a auto rental facility and carwash is permitted in
the M-1 Zone. The proposal which entails construction of a new auto rental facility '
is an appropriate use such that the site will be aesthetically enhanced and an
additional auto rental facility will facilitate and provide a service for the tourism that
lands at the Palm Springs Airport.
b. That the said use is necessary or desirable for the development of the community,
is in harmony with the various elements or objectives of the General Plan, and is
not detrimental to existing uses or to future uses specifically permitted in the zone
in which the proposed use is to be located.
The subject proposal will develop a vacant piece of land due the proposed
building. The project is in harmony with the objectives of the General Plan and /

shall not be detrimental to other uses in the subject zone. It will provide a service
to the community and will aesthetically enhance the neighborhood.
C. That the site for the intended use is adequate in size and shape to accommodate
said use, including yards, setbacks, walls or fences, landscaping and other
features required in order to adjust said use to those existing or permitted future
uses of land in the neighborhood.
The subject application proposes the construction of new auto rental facility which
is consistent with the current requirements set forth in the Zoning Ordinance such
as setbacks, building heights, lot coverage, etc. The conditions of approval
attached to this report will ensure that compliance with the Zoning Ordinance and
local rules and regulations is achieved to the extent possible. All of the proposed
improvements will enhance the property as well as the surrounding neighborhood
and would not otherwise occur without this proposal.
d. That the site for the proposed use relates to streets and highways properly
designed and improved to carry the type and quantity of traffic to be generated by
the proposed use.
The subject site is bordered with street improvements capable to handle the
expected traffic generated by this project. The project will not impact the existing
roadways (Airport Center Drive, Paseo Dorotea, Ramon Road) such that the
roadways in the general vicinity of the subject site have been improved to the
ultimate width pursuant to the General Plan.
e. That the conditions to be imposed and shown on the approved site plan or in
' Exhibit A of this resolution are deemed necessary to protect the public health,
safety and general welfare and may include minor modifications of the zone's
property development standards.

Section 3: Pursuant to Chapter 5.72.010 of the Palm Springs Municipal Code,
the City Council finds that:
a. The applicants, Enterprise Rent-a-car, are of good moral character such that their
business is recognized nation wide and the development of the project site will
enhance the overall look of Ramon Road.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council
approves the establishment of a new auto rental facility with a carwash subject to those
conditions which are on file in the office of the City Clerk.
