HomeMy WebLinkAbout19347 - RESOLUTIONS - 9/2/1998 RESOLUTION NO. 19347 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT NO. 5.0782 FOR A PROPOSED ' REDESIGNATION OF TACHEVAH DRIVE, BETWEEN AVENIDA CABALLEROS AND SUNRISE WAY, FROM A SECONDARY THOROUGHFARE TO A COLLECTOR STREET, SECTION 11, AND MAKING FINDINGS IN SUPPORT THEREOF. ------------- WHEREAS, the City of Palm Springs, (the "applicant") has initiated a proposed General Plan Amendment in accordance with applicable law to redesignate Tachevah Drive, between Avenida Caballeros and Sunrise Way, from a Secondary Thoroughfare to a Collector Street, Section 11; and WHEREAS, the application was submitted to appropriate agencies as required by the Palm Springs Municipal Code, with the request for their review, comments and requirements; and WHEREAS, a traffic study was prepared by a licensed traffic engineer in conjunction with this application and the related application for Tentative Tract Map No. 28610 to assess current and projected traffic flows along the section of Tachevah Drive from Avenida Caballeros to Sunrise Way; and WHEREAS, notice of public hearing of the Planning Commission of the City of Palm Springs to consider the application for General Plan Amendment No. 5.0782 was given in accordance with applicable law; and WHEREAS, on July 8, 1998, a public hearing on the application for General Plan Amendment No. 5.0782 was held by the Planning Commission in accordance with applicable law; and WHEREAS, the Planning Commission voted to recommend unanimous approval of General Plan Amendment 5.0782, subject to the findings in Resolution No. 4592; and WHEREAS, the proposed General Plan Amendment No. 5.0782 is considered a "project" pursuant to the terms of the California Environmental Quality Act (CEQA); and a Mitigated Negative Declaration has been prepared for this project and has been distributed for public review and comment in accordance with CEQA; and WHEREAS, notice of public hearing of the City Council of the City of Palm Springs to consider the application for General Plan Amendment 5.0782 was given in accordance with applicable law; and WHEREAS, on September 2, 1998, a public hearing on the application for the General Plan Amendment 5.0782 was held in accordance with applicable law; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including, but not limited to the staff report, and all written and oral testimony presented. �1B ge4 Page 2 2 a5�Pa THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section : Pursuant to CEQA, the City Council finds as follows: a. The final Mitigated Negative Declaration has been completed in compliance with CEQA, the State CEQA Guidelines, and the City's CEQA Guidelines. The , Planning Commission has previously reviewed and the City Council has independently reviewed and considered the information contained in the Mitigated Negative Declaration and finds that it adequately discusses any significant environmental effects of the proposed project, and that, on the basis of the initial study ar,d comments received during the public review process, there is no substantial evidence that there will be any significant adverse environmental effects as a result of the approval of this project. The City Council further finds that the Mitigated Negative Declaration reflects its independent judgment. b. Pursuant to Fish and Game Code Section 711.4, this project has a de minimus impact on fish and wildlife. Section 2: Pursuant to the proposed General Plan Amendment request, the City Council finds as follows: The proposed General Plan Amendment applied for is necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the General Plan, and is not detrimental to existing uses or to future uses specifically permitted in the zone in which the proposed use: is to be located. The proposed redesignation of Tachevah Drive from a Secondary Thoroughfare to a Collector Street between Avenida Caballeros and Sunrise Way has been analyzed by a licensed traffic engineer. A Traffic Study was prepared in conjunction with the investigation of this request and It was concluded that, in summary, the current and ultimate average daily tripes for this section of Tachevah :Drive, including buildout of any 'vacant areas in close proximity to the study area, would not be of a volume that would necessitate a Secondary Thoroughfare width street and maintain the level of service desirable for the immediate area. In addition, future dedication from residents that own property adjacent to Tachevah Drive, which could have a potentially detrimental effect on said residents, will not be necessary with the redesignation of Tachevah Drive to a street with a reduced right-of-way width. Section 3: Pursuant to Government Code Section 66473.5, the City Council finds that the proposed redesignation of Tachevah Drive and the provisions for its design and improvement are compatible with the objectives, policies, and general land uses and programs provided in the City's General Plan; and R19347 Page 3 NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby approves General Plan Amendment No. 5.0782, in conjunction with approval of Tentative Tract Map No. 28610, per Attachment A, on file in the Office of the City Clerk.
