HomeMy WebLinkAbout19328 - RESOLUTIONS - 7/15/1998 RESOLUTION NO. 19328 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA OVERRULING THE PROTEST ON THE SPREAD OF ANNUAL ASSESSMENTS, AND CONFIRMING THE ENGINEER'S REPORT,DIAGRAM AND ASSESSMENT SPREAD FOR PARKWAY MAINTENANCE DISTRICT NO. 8 "VINTAGE PALMS" TRACT 2,1583-1 and PARCEL MAP 25864, AT SAN RAFAEL DRIVE AND , AVENIDA CABALLEROS, FOR FISCAL YEAR 1998/99. WHEREAS in accordance with the provisions of the Landscaping and Lighting Act of 1972 that the Engineer of Work has determined the estimated maintenance costs for the first year in order to prepare the annual spread of assessment; sad WHEREAS July 15, 1998, was set as the dale to hear protests on the spread of assessment for Parkway Maintenance District No. 8; and WHERAS notice was duly given by publication and a hearing duly conducted at which all intores(ed persons testified; and WHEREAS written protests have been received representing less than fifty percent (50'%o) of the area of assessable lauds within the maintenance area; and WHEREAS spread of assessment shall be forwarded to [lie County Tax Collector who, in turn,shall place this assessment on the County Taw: Roll. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows: Section 1. Description of work: To maintain the landscaped parkway along the norilh side of San Rafael Drive and along Avenida Caballeros north of San Rafael Drive along the offsite frontages of TR.24533-1 and PM. 25864 as described in detail in the Enl;ineer's Rcpor(. Section 2. That all protests, if any, are hereby overruled for Parkway Maintenance District NoX Section 3. The improvements, assessment amount, spread of assessment and the diagram as set out in the engineer's report are hereby confirmed for fiscal year 1998/99. (No Increase - Surplus in 1997/98 resulted in credit with lowered assessments in 1998/99). Section 4. The City Clerk is ]hereby ordered and directed to file a certified copy of the diagram and assessment roll with the County Tax Collector, together with a certified copy of this Resolution upon its adoption and the auditor is requested to collect such assessntcats on the lax roll in (lie same manner and subject to the same penalties for lion-paymcmt as are county properly taxes. Section 5. This project is s(atutorily exempt front CEQA under Section 15273 of the guidelines as an ongoing maintenance charge. All work is in accordance with (lie Landscaping and Lighting Act of 1972 (Part 2 of Division 15), Section 22500 of the Streets and Highways Code and Article X11D, Section 4 of the California Constitution (Proposition 218).
