OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING THE ACQUISITION OF PROPERTY
RELATED TO FARRELL DRIVE RELOCATION ;
PENNINGTONJORRO, AND ACCEPTING A RELEASE OF LAND
BY THE FEDERAL AVIATION ADMINISTRATION. '
WHEREAS the Palm Springs Regional Airport's master planned Runway Extension requires the
relocation of Farrell Drive to property not presently owned by the Airport; and
WHEREAS the Airport, with the assistance of Ernest Noia, Realtor, has negotiated with the
Bureau of Indian Affairs to consummate an exchange of Airport property for the needed Indian
allottee property; and
WHEREAS the property involved was appraised by Robert Lea, M.A.I., after being mutually
selected by all parties; and
WHEREAS Renona Pennington has filed all necessary paperwork with the Bureau of Indian
Affairs to authorize the exchange of property and the BIA has begun its review period; and
WHEREAS the City has formally requested and received a release of property frorn the Federal
Aviation Administration so that Airport property can be exchanged for the Pennington
property,
NOW THEREFORE BE IT RESOLVED that the City Council hereby approves the Farrell Drive
relocation property acquisition program as follows:
SECTION 1 . Ernest G. Noia is appointed Realtor for the Indian allottee land portion of the
acquisition program and shall be compensated at 4.85% of the appraised value
of Indian lands acquired.
SECTION 2. The City Manager is authorized to execute all necessary documents in a form
approved by the City Attorney, through a mutually acceptable escrow company,
to complete the following transactions:
A. Exchange of Airport parcels 4, 5 & 6 (see attached map) lulus $1 50,000,
closing costs, and up to $29,500 Pennington legal costs for Pennington
parcels 1 , 2 & 7; and
B. Purchase of Right-of-Way from the Torro Estate parcel 3 (see attached
map) for $70,000 plus closing costs; and
C. Accept an eighteen month construction easement, beginning with the
closing date of the Torro or Pennington acquisition, whichever is later,
including $100 per day liquidated damages 1$18,000 to be deposited
with Bureau of indian Affairs as show of good faith) for work not
completed within the easement period.
D. Pay the Bureau of Indian Affairs Administrative 1 % Fee; $24,900 '
Pennington and $300 Torro.

SECTION 3. The City Manager is authorized to accept on behalf of the City an Instrument
of Release Dated January 23, 1998, from the United States of America, Federal
Aviation Administration, including all restrictions, pertaining to the Farrell Drive
relocation acquisition program.
