HomeMy WebLinkAbout19189 - RESOLUTIONS - 1/21/1998 RESOLUTION NO. 19189 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING THE ACQUISITION OF LAND FOR A RIGHT- OF-WAY FOR THE RE-ALIGNMENT OF FARRELL DRIVE LOCATED ON THE EAST SIDE OF FARRELL ' DRIVE, 292 FEET NORTH OF COMPUTER 'WAY IN SECTION 12, TAS, RAE., WHEREAS, a portion of the land on the east side of Farrell Drive, 292 feet north of Computer Way is owned by Michael Levin et al., referred to as the Levins property; and WHEREAS, a portion of the Levins property is needed by the; City of Palm Springs for the re-alignment,of Farrell Drive; and WHEREAS, an MAI appraiser determined that the fair market value of that portion of the Levins property needed by the City is $15,000; and WHEREAS, the Levins were offered $15,000 with the City paying all escrow and title closing costs, and the offer was accepted by the Levins; and WHEREAS, the Levins have signed an "AGREEMENT FOR PURCHASE AND SALE OF REAL PROPERTY AND ESCROW INSTRUCTIONS" which is on file in the City Clerk's office. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm , Springs, California, as follows: Section 1. The; City Council approves the "AGREEMENT FOR PURCHASE AND SALE OF REAL PROPERTY AND ESCROW INSTRUCTIONS", offering; to acquire that portion of the Levins property needed for right-of-way to re-align Farrell Drive for the sum of$15,000, plus all title and escrow fees. Section 2. That the City Manager and City Cleric are hereby authorized to sign all documents approved by the City Attorney, on behalf of the City of Palm Springs, necessary to consummate the acquisition of said property. Section 3. That the City Clerk is hereby authorized to accept the Grant Deed and arrange for it to be recorded in the County Recorder's office on behalf of the City of Palm Springs.
