HomeMy WebLinkAbout19093 - RESOLUTIONS - 7/16/1997 go RESOLUTION NO. 19093 ' OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, CONFIRMING SPREAD OF ASSESSMENT FOR STREET LIGHTING MAINTENANCE DISTRICT NO. 1 (BELARDO AREA) AND NO. 2 (MCMANUS DRIVE) FOR FISCAL YEAR 1997198. WHEREAS in accordance with the provisions of the Street Lighting Act of 1931 , Division 14, Part 2 of the Streets and Highways Code, beginning with Section 18300, it is required that the Superintendent of Streets determine actual maintenance costs of the previous year and an estimate of costs for the ensuing year in order to prepare the annual spread of assessment; and WHEREAS the Street Lighting Act of 1931 requires public hearings every five (5) years (the last public hearing was held on July 17, 1996) approving the spread of assessments for the next five (5) years, commencing with fiscal year 1997/98 through 2000/2001; and WHEREAS spread of assessment is forwarded to the County Tax Collector who, in turn, includes this assessment on the County Tax Roll. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as ' follows: Section 1 . The improvement commonly known as "Street Lighting Maintenance District No. 1 ," (Belardo Area) and No. 2 (McManus Drive) the boundaries of which are on file in the Office of the City Clerk, and incorporated herein by reference, shall be maintained, pursuant to said Streets & Highways Code, for a period of five years commencing July 1 , 1996, and ending June 30, 2001 . Section 2. The spread of assessment for fiscal year 1997/98 for Street Lighting Maintenance District No. 1 (Belardo Area) and No. 2 (McManus Drive) on file in the office of the City Clerk and incorporated herein by reference, is hereby confirmed. Section 3. That all protests, if any, for Street Lighting Maintenance District No. 1 and No. 2 are hereby overruled (no cost increases in 1997/98). Section 4. The City Clerk is hereby directed to certify the said spread of assessment and map and forward same to the County Tax Collector prior to the third Monday of August, in accordance with Section 18401 of the Streets and Highways Code of the State of California. Section 5. This project is statutorily exempt from CEQA under Section 15273 of the ' guidelines as an ongoing maintenance charge. All proceedings are pursuant to the Street Lighting Act of 1931 (Division 14, Part 2 of the Streets and Highways Code, and Article XIIID, Section 4 of the California Constitution (Proposition 218).
