HomeMy WebLinkAbout19090 - RESOLUTIONS - 7/16/1997 RESOLUTION NO. 19090 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING PRELIMINARY PLANNED DEVELOPMENT DISTRICT CASE 5.0743-PD- 248 TO ALLOW THE CONSTRUCTION OF A 52-UNIT SENIOR HOUSING COMPLEX, ; INCLUDIN,; A 25% DENSITY BONUS; A DENSITY TRANSFER OF TWO ' RESIDENTIAL UNITS WITHIN THE PROJECT SITE; CONSIDERATION OF MODIFIED PARKING AND DEVELOPMENT STANDARDS; AND A LAND SUBDIVISION, FOR THE PROPERTY LOCATED AT 1207 AND 1211 VISTA CHINO, WEST OF SUNRISE WAY, R-2 ZONE, SECTION 11 . WHEREAS, The City of Palm Springs Redevelopment Agency and the Office of Housing and Urban Development, (the "Applicants") filed an application with the City pursuant to Section 9403. 00 of the Zoning Ordinance for a Planned Development District application to allow the construction of a 52-unit senior apartment housing facility (the "Project") , located on Vista Chino west of Sunrise Way, R-2 Zone, Section 11; and WHEREAS, the proposed buildings are located in the R-2 Zone and the applicant is requesting modification of certain development standards for which a Planned Development District would be required; and WHEREAS, the existing senior housing project in the immediate vicinity has existed for two years with modified development , standards and no negative impact has been identified, and therefore the request for an increase in density, a density transfer, and modified parking and development standard requirements, is outweighed by the benefits provided by the development of this vacant parcel; and WHEREAS, the Environmental Assessment prepared by staff identified less than significant impacts, thus construction of the project should have no adverse negative impacts on the environment; and WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm Springs to consider an application for Planned Development District Case 5. 0743-PD-248 was held by the Planning Commission in accordance with applicable law; and WHEREAS, on July 9, 1997, a public hearing on the application for Planned Development District Application Case 5. 0743-PD-248 was held by the Planning Commission in accordance with applicable law; and WHEREAS, notice of a public hearing of the City Council of the City of Palm Springs to consider an application for a Planned Development District Case 5. 0473-PD-248 was held by the City ' Council in accordance with applicable law; and WHEREAS, on July 16, 1997, a public hearing on the application for a Planned Development District Application Case 5. 0473-iPD-248 was held by the City Council in accordance with applicable laid; and WHEREAS, the City Council has carefully reviewed and considered all q of the evidence presented in connection with the hearing on the R19090 q� Page 2 project, including but not limited to the staff report, all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1 : A Negative Declaration has been completed in compliance with CEQA, the State CEQA Guidelines, ' and the City's CEQA Guidelines. The City Council has independently reviewed and considered the information contained in the Negative Declaration and finds that it adequately discusses the significant environmental effects of the proposed project, and that, on the basis of the environmental assessment and comments received during the public review process, there is no substantial evidence that there will be any significant adverse environmental effects as a result of the approval of this project. The City Council further finds that the Negative Declaration reflects its independent judgment. Section 2: Pursuant to Zoning Ordinance Section 9402 .00, the City Council finds that: a. The use applied for at the location set forth in the application is properly one for which a Planned Development is authorized by the City' s zoning ordinance. b. The use applied for is necessary or desirable for the development of housing for the senior community, and is not ' detrimental to the existing or future uses specifically permitted in the zone in which the proposed use is to be located. C. That there is little or no probability the project will be detrimental to or interfere with the existing and or future development in the area and that as established in the initial study, impacts are less than significant. d. The proposed use is consistent with the General Plan and will complement existing and proposed uses in the vicinity. e. The site for the intended use is adequate in size and shape to accommodate said use, including yards, setbacks, walls or fences, landscaping and other features required in order to adjust said use to those existing or permitted future uses of the land in the neighborhood. f. The site for the proposed use relates to streets and highways properly designed and improved to carry the type and quantity of traffic to be generated by the proposed use. g. The conditions to be imposed are deemed necessary to protect the public health, safety and general welfare, of the ' existing neighborhood in which this project is situated. h. The transfer of two residential units from the remaining street frontage parcel to the project site is desirable for the development of the City senior housing stock. Furthermore, the density transfer would not increase the overall density allowed if the existing parcel was not subdivided. R19090 Page 3 i . Due to the density transfer, the remaining street frontage parcel will be limited to 16 residential units by right of zone. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby orders the filing of the Negative Declaration and approves the Preliminary Planned Development District Application Case 5. 0659-PD-229 subject to those conditions set ' forth in the attached Exhibit A, which are to be satisfied prior to the issuance of a Certificate of Occupancy unless otherwise specified.
