OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, OPPOSING THE MODIFICATION OF THE
SPHERE-OF-INFLUENCE BOUNDARY OF THE CITY OF PALM
SPRINGS BY THE RIVERSIDE LOCAL AGENCY FORMATION
COMMISSION.
WHEREAS the Riverside Local Agency Formation Coimnission(LAFCO) approved a Reorganization
to Include Annexation 26 to the City of Palm Springs by Resolution No. 69-93 on October 28, 1993;
and
WHEREAS LAFCO, along with such action, approved the current sphere-of-influence boundaries for
the City of Palm Springs; and
WHEREAS such Reorganization to Include Annexation 26 became effective on October 15, 1995; and
WHEREAS, as a condition of approval of the Reorganization, LAFCO required that the City of Pahn
Springs enter into an annexation agreement with Riverside County to provide, among other things, the
efficient provision of public safety services to areas remaining unincorporated; and
WHEREAS such annexation agreement was approved by the City Council on October 5, 1994, and
' signed by responsible parties of both the City and Riverside County; and
WHEREAS such agreement was followed by an agreement between the Palm Springs and Riverside
County Fire Departments on August 26, 1996,to provide fire protection services; and
WHEREAS LAFCO has considered an application, by residents of North Palm Springs, Valley View
Ranchos and Painted Hills, and adjacent areas, for designation of the unincorporated area between the
Cities of Palm Springs and Desert Hot Springs as a Community of Interest; and
WHEREAS the area being considered under such application includes areas within the current sphere-
of-influence of the City of Palm Springs; and
WHEREAS the City of Palm Springs has gone on record, by letter of the Mayor, dated June 19, 1996,
as being opposed to the Community of Interest application for a number of reasons, including the fact
that such application directly impacts the City's sphere-of-influence; and
WHEREAS the City of Palm Springs has learned that, whether or not the Community of Interest
application is approved, LAFCO may consider a change in the boundaries of the City's sphere-of
influence; and
WHEREAS the City of Palm Springs has not been afforded the opportunity to evaluate the impact of a
' proposed change to its sphere-of-influence; nor has it been afforded the opportunity to enter into
discussion with the City of Desert Hot Springs regarding such matter; nor has it been afforded the
opportunity to enter into discussion with Riverside County regarding the effect of the proposed change
of its sphere-of-influence on the existing annexation agreement.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Palm Springs,
California, as follows:
Section I The City of Palm Springs remains opposed to the application for the North Palm
Springs Community of Interest for those reasons stated in the letter of the Mayor to the Executive
Director ofLAFCO, dated June 19, 1996. '
Section 2. The City of Palm Springs is opposed to any modification of its sphere-of-influence by
the Riverside Local Agency Formation Comnvssion until such time that the City has been afforded the
opportunity to evaluate the impact of a proposed change to its sphere-of-influence; and the City has
been afforded the opportunity to enter into discussion with the City of Desert Flot Springs regarding
such matter; and the City has been afforded the opportunity to enter into discussion with Riverside
County regarding the effect of the proposed change of its sphere-of-influence on the existing
annexation agreement required by LAF CO.
