HomeMy WebLinkAbout18954 - RESOLUTIONS - 1/8/1997 ]RESOLUTION NO. 18954 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ESTABLISHING THE CHARTER REVISION COMMITTEE WHEREAS, it is in the city's interest to evaluate and review the existing City Charter and its organization, policies and procedures to determine if there are improvements that could be made in order to improve the City's services to the community and to minimize the cost of City government; and WHEREAS, the City Council has determined that creating a committee of informed citizens to perform this review function and to make recommendations to the City Council is valuable and prudent; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. creation. There is hereby created .in and for. the City of Palm Springs a Charter Review Committee ("CRC") which shall be a temporary committee. Section 2 . Purnc)se. The purposes of the CRC are as follows: (a) To review and evaluate the City charter and the current organization, policy and procedures of the City; ' (b) To evaluate the responsiveness and quality of City services and all direct and indirect: costs of the City organization; (c) To recommend changes and ilmprovemento, to the city's organizational structure in order to reduce costs and improve efficiency and responsiveness to the community in the city's services; (d) To receive:, process, and respond to citizen complaints and recommendations regarding 'the City Charter; (e) To identify the impact of suggested changes to the organizational structure of the. City government on the community; (f) To consider and review other cities' organ- izations structures and policies and procedures and related costs. CRC shall. have regularly :scheduled meetings and shall provided to the City Council (i) copies of the minutes of each CRC meeting, and (i.i) monthly reports on the status of the ' CRC's work. The final result of the CRC's work shall be a written report to the City Council, incorporating all of the above- discussed considerations. The initial report of the CRC shall. be submitted to the City Council no later than June 1, 1.997 which shall contain (i) recommendations for the 1997 municipal election, and (ii) a summary, if applicable, of subjects for, further study. 053/014084-0001/304'1918.1 m1112/23/96 Section 3 . Makeup of CRC. It is the City Council's intent that composition of the CRC reflect a broad base of expertise in various disciplines including, but not limited to, finance, accounting, law, management, engineering, local government, etc. Section 4. Composition. The CRC shall consist of seven (7) members. ' Section 5. Appointment. The members of the CRC shall be appointed in conformity with Resolution No. 18804 governing appointments to City boards and commissions. Section 6 . Term. (a) The, CRC shall be in existence for and the term of each member thereof shall be for a maximum of one (1) year from the date of the adoption of this resolution, or until a report of the CRC making findings and recommendations to the City Council as required by Section 2 hereof is acted upon by the Council, whichever shall first occur. The CRC shall be disbanded automatically at the end of this term, unless extended by the City Council by amendment of this Resolution. (b) Any member may resign with prior written notice to the CRC chairperson and City Council. Any member may be removed at any time by a majority vote of the City Council. (c) No member may serve on any other City of Palm Springs committee or commission. (d) If any CRC member misses more than three (3) ' meetings that member shall be subject to removal from the CRC pursuant to the provision of Section 605 of the City Charter. A replacement member shall thereafter be appointed in the manner set forth in Section 5. Section 7 . Residency. Prospective members of the CRC shall be residents and registered voters of the City of Palm Springs. Section 8 . Financial Interest. Persons who participate in the CRC will be precludes] from having any financial interest in the City of Palm Springs during their service on the CRC, or for one (1) year thereafter. Violation of this restriction shall be deemed a misdemeanor punishable as provided in the Palm Springs Municipal Code. For purposes of determining whether a member has a "financial interest" as used in this Section, the term "financial interest" shall have the meaning applied to that term pursuant to the Political Reform Act of 1974 (Government Code § 81000, et sea. ) . Violation of this provision shall be grounds for revocation of any City permit. Section 9. Meetings. (a) Following appointment, the CRC shall, at its first meeting, select a chairperson whose term of office shall be concurrent with his/her term of appointment. (b) At any meeting of. the CRC, the majority of the members shall constitute a quorum for purposes of conducting business or meetings. (c) The CRC shall be an advisory body to the City Council. All business of the CRC shall be conducted in 053/014084-0001/3041918.1 m12/23/96 -2- compliance with the Ralph M. Brown Act (Government Code § 54950, et seg. ) and all CFTC meetings shall be open and public. (d) All CRC meetings shall be held in. the Palm Springs City Hall. unless otherwise directed by the CRC. The meeting time and day of such meeting shall be determined at the first convened CRC meeting, and established by resolution of the CRC. ' (e) The CRC shall keep a record of its proceedings which shall be a public record. (f) The CRC and its members shall be. subjiect to the terms of the Political Reform Act of 1974 . (g) The proceedings of the CRC: shall be conducted in accordance: with Robert's Rules of Order. Section 10. Staffing. The City Manager may determine it appropriate to, and may designate as the: ex-officio repre- sentative(s) to the CRC,, one or more members of the City staff. Section 11. ComDensation. Members of the CRC shall serve without compensation for their services. Section 12 . Applications for Appointment. The City Clerk is directed to solicit applications for appointment to the CRC pursuant to City Resolution 18804 and to coordinate scheduling interviews in order to enable appointment of the CRC by January 22, 1.997. Adopted this 8th day of January, 1997 .
