OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING CASE 5. 0574-PD--
215 AND TENTATIVE TRACT MAP 26364 SUBJECT TO
REVISED CONDITIONS OF APPROVAL, FOR A. 77 UNIT
SINGLE FAMILY RESIDENTIAL SUBDIVISION LOCATED
AT THE NORTHWEST.' CORNER OF SUNRISE WAY AND VIA ,
ESCUELA, R-1-C ZONE, SECTION 2 .
WHEREAS, Westmark Communities Inc. , (the "Applicant.") has filed an
application with the City pursuant to Section 9402 . 00 of the Zoning
Code and the Palm Springs Municipal Code Section 9. 60 for a Revised
Planned Development District and a Tentative Tract Map to subdivide
20 acres into a 77 unit single family residential lots at the
northwest corner of Vista Chino and Sunrise Way (the "Project") , R-
1-C Zone, Section 2 ; and
WHEREAS, on November 27 , 1996, a meeting on the revised conditions
for Case 5. 0574-PD-215 and Tentative Tract Map 26364 were held by
the Planning Commission in accordance with applicable law; and
WHEREAS, the proposed Subdivision, Case 5. 0574-1:'D-215 and Tentative
Tract Map 26364, are considered a "project" pursuant to the terms
of the California Environmental Quality Act ("CEQA") , and a
Negative Declaration ].-gas been prepared for this project and has
been distributed for public review and comment in accordance with
CEQA and was recorded on June 19, 1991, with the County of
Riverside; and
WHEREAS, at the conclusion of its meeting on November 27, 1996, the '
Planning Commission adopted Resolution No. 4520, recommending that
the City Council approve revised Planned Development District No.
215-TTM 26364 , subject to the findings and conditions stated in
Resolution No. 4520; and

WHEREAS, on December 4 , 1996, a meeting on the application for the
revised PD--215-TTM 26364 , was held by the City Council in
li accordance with applicable law; and
! WHEREAS, the City Council has carefully reviewed and considered all
of the evidence presented in connection with the meeting on the
Project, including but not limited to the staff report, all
environmental data including the initial study, the proposed
j Negative Declaration and all written and oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section a_: Pursuant to CEQA, the City Council finds as
follows:
a. Because mitigation measures identified in the Negative
Declaration recorded on June 19,, 1991, have been
incorporated into the Project which mitigate any
potential significant environmental effects to a point
where clearly no significant environmental effects will '
occur as a result of the project. The mitigation measures
adopted are identified as conditions of approval.

215-TTM 26364, subject to the findings and conditions stated in
Resolution No. 4520; and
WHEREAS, on December 4, 1996, a meeting on the application for the
revised PD-215-TTM 26364 , was held by the. City Council in
accordance with applicable law; and
WHEREAS, the City Council has carefully reviewed and considered all
of the evidence :presented in connection with the meeting on the
Project, including but not .Limited to the staff re, ort., all
environmental data including the initial study, the proposed
Negative Declaration and all written and oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:

NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing,
the City Council hereby approves Case 5. 0574-PD-215 and Tentative
Tract Map 26364 subject to those revised conditions set forth in
the attached Exhibit A, on file in the City Clerk's office, which
are to be satisfied prior to the issuance of a Certificate of
Occupancy unless other specified.
