OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING A REQUEST BY
THE PALM SPRINGS DESERT MUSEUM TO ALLOW A FIVE
YEAR TIME EXTENSION TO COMPLETE CONDITION #16
(OF THE PALM SPRINGS DESERT MUSEUM PLANNED
' DEVELOPMENT DISTRICT 5 . 0663-PD-230) REQUIRING
THE GRANTING OF A PERMANENT TRAIL EASEMENT TO
THE CITY FOR PUBLIC ACCESS AND TO COMPLY WITH
OPEN SPACE REQUIREMENTS, LOCATED AT 101 MUSEUM
DRIVE, PD-230, SECTION 15
WHEREAS, the Palm Springs Desert Museum (Desert Museum) has
requested a time extension of five years to complete the remaining
requirements of Condition #16 as well as comply with open space
requirements of the approved Desert Museum Planned Development
District #230; and
WHEREAS, the remaining requirement of Condition #16 requires the
Desert Museum to grant a permanent trail easement to the City of
Palm Springs for public access to the Museum Trail ; and
WHEREAS, the majority of this trail traverses property which was
intended to be owned at this time by the Desert Museum but is
currently under separate ownership; and
WHEREAS, the Desert- Museum has made many attempts within the last
two years and continues to attempt to resolve differences with the
adjacent property owner in order to fulfill agreements to obtain a
one acre portion of hillside property in order to complete the
trail easement requirement and to comply with open space
' requirements; and
WHEREAS, the Desert Museum wishes to open its new building addition
to the public prior to accomplishing the above mentioned land
transactions but will continue to work with the adjacent property
owner to fulfill the requirement of Condition #16 as well as comply
with open space requirements within the next five years; and
WHEREAS, on September 25, 1996, the Planning Commission of the City
of Palm Springs voted to recommend approval of the five year time
extension for Condition #16 and to comply with open space
requirements; and
WHEREAS, on October 16, 1996, the City Council of the City of Palm
Springs has considered the five year time extension for Condition
#16 and to comply with open space requirements .

NOW,. THEREFORE, BE IT RESOLVED that the City Council does hereby
approve a five year time extension to complete the remaining
requirement of Condition #16 (Exhibit A - Condition on file in the
office of the City Cleric) as well as to comply with the open space
requirements of the Palm Springs Desert Museum Planned Development
District #230 .
