OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING CASE
5. 07140/PD-243 SUBJECT TO THE CONDITIONS
STATED, FOR A PRELIMINARY AND FINAL PLANNED
DEVELOPMENT DISTRICT INCLUDING A MULTI-PURPOSE
' EDUCATIONAL BUILDING, PARKING IMPROVEMENTS AND
LANDSCAPING FOR AJALON BAPTIST CHURCH LOCATED
AT TRAMVIEW ROAD AND GRANADA AVENUE, R-1-D
ZONE, SECTION 34 .
WHEREAS, Ajalon Baptist Church, (the "Applicant") has filed an
application with the City pursuant to Section 9402 . 00 of the Zoning
Code and the Palm Springs Municipal Code Section 9 . 60 for a Planned
Development District application including a multi-purpose
educational building, redesign the existing parking lot, add a
second parking lot, and add landscaping at the southeast corner of
Tramview Road and Granada Avenue, (the "Project") , R-1-D Zone,
Section 34; and
WHEREAS, notice of a public hearing of the Planning Commission of
the City of Palm Springs to consider Applicant's application for
Planned Development District 243 was given in accordance with
applicable law; and
WHEREAS, on July 10, 1996, a public hearing on the application for
Planned Development District 243 was held by the Planning
Commission in accordance with applicable law; and
' WHEREAS, at the conclusion of its public hearing on July 10, 1996,
the Planning Commission adopted Resolution No. 4503 , recommending
that the City Council approve Planned Development District No 243,
subject to the findings and conditions stated in Resolution No.
4503 ; and
WHEREAS, notice of a public hearing of the City Council of the City
of Palm Springs to consider Applicant's application for Planned
Development District 243 was given in accordance with applicable
law; and
WHEREAS, on July 17, 1996, a public hearing on the application for
Planned Development District 243 was held by the City Council in
accordance with applicable law; and
WHEREAS, the City Council has carefully reviewed and considered all
of the evidence presented in connection with the hearing on the
project, including but not limited to the staff report, and all
written and oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds as
follows:
The project is categorically exempt from the requirements of
CEQA pursuant to Section 15301 which states that projects are
exempt from CEQA if additions to existing structures are under
10,000 square feet and if the project is in an area where all
public services and facilities are available, and located in
an area that is not environmentally sensitive.

Section 2 . Pursuant to Ordinance Section 9403 . 00B, the City
Council finds that:
a. The use applied for at the location set forth in the
application are properly ones for which a Planned Development
District is authorized by the City's Zoning Ordinance.
b. The use applied for are necessary or desirable for the ,
development of the community, are in harmony with the various
elements of objectives of the General Plan, and are not
detrimental to existing uses or to future uses specifically
permitted in the zones in which the proposed uses are to be
located.
C. The site for the intended uses is adequate in size and
shape to accommodate said uses, including yards, setbacks,
walls and fences, landscaping and other features required in
order to adjust said uses to those existing or permitted
future uses of the land in the neighborhood.
d. The site for the proposed uses related to the streets and
highways properly designed and improved to carry the: type and
quantity of traffic to be generated by the proposed, use.
e. The conditions to be imposed and shown on the approved
site plan are deemed necessary to protect the public health,
safety and general welfare, including any minor modifications
of the zone's property development standards.
f. A nexus and rough proportionality have been established
for requirements of dedication of the additional right-of-way
to the City and the off-site improvements as related to the to
the planned development district application. ,
The right-of-way dedication and off-site improvements, which
are required by the Zoning Ordinance, are related to the
project since the property owners must use. Tramview Road and
Granada Avenue to access the site. Also, the purpose of the
right-of-way dedication for Tramview Road and Granada Avenue
are to provide additional right-of-way for the corner- cut-back
to meet City standards. The required dedication of right-of-
way and improvements will provide safety benefits to the
property owners and will aesthetically enhance the
neighborhood.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing,
the City Council hereby approves the Preliminary and Final Planned
Development District 243 subject to those conditions set, forth in
Exhibit A on file in the City Clerks office„ which are to be
satisfied prior to the issuance of a Certificate of Occupancy
unless otherwise specified.
