OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, UPHOLDING THE PLANNING
COMMISSION DECISION CONCERNING THE SIGN
APPLICATION I3Y MARTIN COMMUNICATIONS FOR THE
INSTALLATION OF THREE BILLBOARDS ALONG GENE
AUTRY TRAIL, NORTH OF VISTA CHINO, W ZONE, '
SECTION 6.
WHEREAS, Andrew Goodman, representing Martin Communications,
filed an appeal of the Planning Commission denial for the
installation of three billboards along Gene Autry Trail, north of
Vista Chino; and
WHEREAS, the Planning Commission considered and denied the
application to install said billboards at its regular meeting
held on June 12 , 1996; and
WHEREAS, the installation of the proposed billboards is ;not in
keeping with the goals and policies of the General Plan; and
WHEREAS, General Plan Policy 5. 15.3 prohibits this type of
billboards; and
WHEREAS, views along the City's scenic corridors, protected by
General Plan Policy 5. 24 . 1, can be destroyed and ultimately
decrease property valuers within the City boundaries; and
WHEREAS, General Plan Objective 5. 25. 1 provides for enhanced City
entryways and the installation of billboards will create '
undesirable entry statements for the City by portraying a
negative image to the tourist that visits the City; and
WHEREAS, the installation of billboards along our scenic
corridors will detract from the linkages between open space
areas, bike paths, and pedestrian walks required by General Plan
Policy 5. 24 . 4 and will contribute to undesirable architectural
and site planning in the future; and
WHEREAS, the City Council of the City of Palm Springs considered
the appeal of the sign application by Martin Communications on
July 3 , 1996, in accordance with applicable law,; and
WHEREAS, the City Council has carefully reviewed and considered
all of the evidence presented in connection with the hearing on
the project, including but not limited to the staff report, and
all written and oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds that this
project is Categorically exempt from California
Environmental Quality Act Guidelines.
Section 2 : Pursuant to Zoning Ordinance Section 9320. 00 '
regarding signs, the City Council finds that:
a. Proper sign control is necessary to maintain the high
aesthetic values which both residents and visitors to the
City have come to expect.

b. The proposed billboards are not in keeping with the
policies and goals of the General Plan especially Policy
5. 15. 3.
C. The views along the City's scenic corridors will be
impacted resulting in property depreciation (General Plan
Policy 5. 24 . 1) .
d. The installation of billboards along the City's scenic
corridors will create undesirable entry statements and
portray a negative image to the tourist community (General
Plan Policy 5.25. ) .
e. The installation of billboards will contribute to poor
architectural and site planning design in the future
(General Plan Policy 5.24 . 4) .
f. That the current Zoning Ordinance (Section 9320. 00) ,
with regard to signs, contains no provision to allow for
this type of advertisement.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing,
the City Council hereby upholds the Planning Commission denial
concerning the installation of three billboards along the west
side of Gene Autry Trail, north of Vista Chino.
ADOPTED this 3rd day of July , 1996.
