OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING THE ACQUISITION OF RIGHT-
OF-WAY FOR THE MID-VALLEY PARKWAY FROM
COACHELLA VALLEY WATER DISTRICT OVER LAND
LOCATED ON THE WEST BANK OF THE W11ITEWATER
RIVER STORMWATER CHANNEL IN SECTION 20, ,
T.4S.,R.5E.,S.B.M.
WHEREAS Coachella Valley Water District hereinafter referred to as C.V.W.D. is the owner
of a 1.087 acre parcel of land :located on the west bank of the Whitewater River Stormwater
Channel in Section 20; and
WHEREAS, C.V.W.D. is willing to convey to the City of Palm Springs hereinafter referred to
as the City an easement for public road purposes,when the City has satisfied the following two
conditions:
1. Prepare a special Grant of Easement document which permits compatible use by
C.V.W.D. for a stormwater channel levee and the City for a public road.
2. The City is to pay C.V.W.D. the appraised value of the land plus any costs and
attorney fees incurred by C.V.W.D.; and
WHEREAS, the C.V.W.D.'s two conditions have been satisfied and C.V.W.D. is ready to grant
the easement to the City of Palm Springs for the right-of-way needed for the Mid-Valley
Parkway. '
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA as follows:
Section 1. That the City Council approve the acquisition of right-of-way for the Mid-Valley
Parkway from C.V.W.D. over the land located on the west bank of the
Whitewater River Stormwater Channel in Section 20, more particularly described
and shown on Exhibit "A" attached hereto and made a part hereof for the sum of
$2,940.00, plus attorney fees and legal costs, and all title and escrow fees.
Section 2. That the City Manager and City Clerk are hereby authorized to sign documents
approved by the City Attorney on behalf of the City of Palm Springs necessary
to consummate the acquisition of said right-of-way.
Section 3. That the City Clerk is hereby authorized to accept the Grant of Easement and
arrange for it to be recorded in the County Recorder's office on behalf of the City
of Palm Springs.

the purposes of establishing, constructing, and operating a public roadway including all uses
incidental thereto, including the placement of storm drains, gutters, drainage improvements,
sidewalks, parkways, lighting, and landscaping, together with the right to place public utilities
on, over, or within the described easement area, with right of ingress and egress for
