HomeMy WebLinkAbout18821 - RESOLUTIONS - 5/1/1996 RESOLUTION NO. 18821 OF THE CITY OF PALM SPRINGS, CALIFORNIA DENYING AN .APPEAL BY NINA BRADY IN REGARD TO AN ACTION BY THE VILLAGEFEST REVIEW BOARD WHICH LIMITS HER TO THE SALE OF ITEMS MADE BY HER AS INCLUDED IN HER ' FORMALLY APPROVED VILLAGEFEST APPLICATIONS, AND THOSE WHICH MAY BE FORMALLY APPROVED BY THE BOARD IN THE FUTURE„ WIIEREAS the City Council has previously approved and subsequently amended The VillageFest Rules and Regulations and has formally appointed a VlllageFest Board to evaluate vendor applications as well as to interpret and apply the provisions of those rules and regulations; and WHEREAS the current VillageFest Board and staff, in the process of reviewing existing VillageFest vendors in regard to their compliance with VillageFestRules and Regulations as well as their formally approved applications, discovered that Nina Brady was not in compliance with either of these; and WHEREAS Nina Brady was subsequently requested to appear before the current VillageFest Board in order to present her position on this mutter to the Board, and she has complied with that request; and WHEREAS, as a result of this review, the current VillageFest Board found that she was not in compliance with either VillageFest Rules and Regulations or her formally approved applications and voted to restrict her participation in ' VillageFest to those items included in her formally approved applications until other items complying with the VlllageFest Rules and Regulations might be formally approved by the Board in the future; and WHEREAS Nina Brady appealed this decision by the VillageFest Board to City Council and her appeal was heard in a Public Hearing of. the Council on May 1, 1996 in which City Council heard testimony on both sides of the issue and voted to deny the appeal by Nina Brady of this action by the VillageFest Board. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs that the appeal. by Nina Brady in regard to the action by the VillageFest Board, which restricts her participation In this event to the sale of those items included in her formally approved applications and those items which may be approved by the VillageFest Board in the future, is hereby denied. ADOPTED on this 1st day of May, 1996.
