RESOLUTION NO. 18820 OF THE CITY COUNCIL Or, THE CITY OF PALM SPRINGS, CALIFORNIA, FINDING AND DETERMINING THAT 'THE ' PUBLIC INTEREST CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN REAL PROPERTY FOR PURPOSES OF PUBLIC ROADWAY IMPROVEMENT'S IN SECTION 20, TA.S.,R.S.E. WHEREAS on April 30, 1996, after no less than 15 days written notice to the owners of property described hereafter, as those owners appeared on the last equalized County Assessment Roll of the City Council of the City of Palm Springs ("City Council") held a hearing for the purpose of allowing the owners of the property a reasonable opportunity to appear and be heard on the following matters. A. Whether the public interest and necessity require the Project. B. Whether the Project is planned or located in a manner which is most compatible with the greatest public good and the least private injury; and C. Whether the property proposed to be acquired is necessary for the Project; and D. Whether the offers required by Government Code Section 7267.2 had been given; and WHEREAS, the City Council, as a result of said hearing, has determined that the public health, ' safety, and welfare require the City to acquire those parcels of real property, more particularly described in Exhibit "A" attached hereto and by this reference made a part hereof, for the purpose of constructing the west end segment of the Mid-Valley Parkway, a 4-lane road that runs along Mesquite Avenue in Palm Springs from Gene Autry Trail to Dinah Shore Drive in Cathedral City and includes the: construction of a 4-lane bridge across the Whi.tewater River Channel and connects Palm Springs to Cathedral City and other valley cities; and WHEREAS, the Project for which the property to be acquired is sought has previously been reviewed under applicable environmental review procedures, and found not to cause any significant environmental impact on the environment; NOW, THEREFORE, BE IT ]RESOLVED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, that the City Council does hereby find, determine, and declare based upon the evidence presented to the City Council as follows: Section 1. The properties to be acquired are located within the City of Palm Springs, County of Riverside, State of California located along Mesquite Avenue between Gene Autry and Dinah Shore Drive, consisting of some 19.0 acres and are more specifically described in Exhibit "A" hereto. Section 2. The public interest and necessity require the project for which the property is ' sought, to wit: The Mid-Valley Project is a Regional Coachella Valley roadway project that is being funded primarily by Measure "A" Regional (1/: cent sales tax funds). Measure "A" was approved by Riverside County voters in Novemb--r, 1988, and the Mid-Valley Parkway was listed on the ballot as one of the must- build roadway projects in Riverside County. The City of Palm Springs is the Lead Agency working on behalf of the Coachella Valley Association of t nlEO SED I-. _.. Y Resolution No. 18820 Page 2 Governments (CVAG) and the current phase is a joint project with CVAG and the City of Cathedral City and City of Palm Springs. The Mid-Valley Parkway (MVP) will provide a new regional roadway arterial, connecting mid-valley cities to Palm Springs via the cities of Palm Desert, Rancho Mirage and Cathedral City. The MVP will relieve two major thoroughfares: Ramon Road and East Palm Canyon Drive (State Highway 111), which are overloaded with traffic and will reach traffic grid-lock if the MVP is not constructed. The MVP will also provide an express route to the Palm Springs Regional Airport. The current Mid-Valley Parkway project was unanimously approved by the Executive Committee of CVAG (all local agencies in Coachella Valley) on 1/9/95 when the CEQA Environmental Impact Report (EIR) and Alignment Study was approved following the 2nd Public Hearing for the Project (3 public meetings and 2 public hearings were held). The current (west end segment) of the Mid-Valley Parkway is a 4-lane $15.7 million project that runs along Mesquite Avenue in Palm Springs from Gene Autry Trail to Dinah Shore Drive in Cathedral City. The Project includes the construction of a new 4-lane bridge which crosses the Whitewater River Channel and connects Palm Springs to Cathedral City. ' The Mid-Valley Parkway is designed to carry over 30,000 cars per day and it is estimated that 10,000 to 15,000 cars per day will use the parkway after it is initially opened to traffic in 1997 (see Exhibit A — Legal Descriptions and Exhibit B — Location Map for project). Section 3. The project is located in a manner most compatible with the greatest public good and the least private injury, to wit: Construction of the Mid-Valley Parkway requires acquisition of right-of-way along the roadway. Circulation throughout the area will benefit from bridge and roadway being constructed. The property being acquired is currently vacant and undeveloped. Consequently, acquisition will not displace any currently operating business or result in the displacement of any resident. Section 4. The property to be acquired is necessary for the project, to wit: The Mid-Valley Parkway cannot be constructed as called for by the General Plan, without additional right-of-way. An easement is required to make this right-of-way available for construction and maintenance of the roadway. Section 5. In connection with those properties in and adjacent to the Whitewater River Channel, to the extent that such property is already appropriated to a public use, ' the City Council finds that the proposed use of the property in the Project is compatible with that use, in that the property will be used to accommodate a bridge which will permit traffic to traverse the Whitewater River Channel, which bridge has been designed to accommodate 100 year flooding event drainage Resolution No. 18820 Page 3 flows, and has been designed to incorporate freeboard above such flows. In addition, the Project will include an access road which will connect, the proposed ' bridge to the west bank of the Whitewater River Channel, to allow access for maintenance and service of all existing improvements. The use for the Project is therefore compatible with any existing public use, and acquisition by eminent domain is therefore authorized under Code of Civil Procedure Section 1240.510. Alternatively, the:: City Council finds that if the use of the property to accommodate a roadway bridge is not consistent with any existing public use, use of the property for the Project is a more necessary public use for all of the reasons stated herein, and acquisition by eminent domain is therefore authorized under Code of Civil Procedure Section 1240.610. Section 6. The acquisition of this property was submitted to and favorably reported upon the City Council by the City of Palm Springs Planning Commission, as to conformity with the City's adopted General Plan pursuant to Section 65402 of the California Government Code. Such findings were made by the; Planning Commission on April 24, 1996. Section 7. The offers required by Government Code Section 7267.2 have been made to the owners of record of the properties to be acquired, by Overland Resources, land and right-of-way services company between March 2.1, 1996, to April 22, 1996. Overland Resources has made all reasonable efforts to reach a negotiated acquisition, but negotiation efforts have not proved successful. ' Section 8. The Project for which the property is sought has been reviewed under applicable environmental regulations, and was the subject of an environmental impact report certified by the Coachella Valley Association of Governments On January 9, 1995. The City Council finds that since the time of that certification there have been no subsequent changes with respect to the circumstances under which the project is undertaken, no new information of substantial importance regarding significant effects or mitigation measures or alternatives has become available, and no subsequent changes have been proposed in the project which would require important revisions of the previous EIR, such that no further environmental review is necessary. Section 9. The City Council of Palm Springs does hereby declare that it is its intention to acquire said properties in the: City's name in accordance with the provisions of the laws of the United States of America and the State of California with reference to Condemnation Procedure. Section 10. The law firm of Rutan & Tucker is hereby authorized and directed to prepare, institute, and prosecute in the name of the City of Palm Springs such proceedings, in the proper court having ,jurisdiction thereof, as may be necessary for the , acquisition of the fee interest to said property.
