OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, FINDING THAT THE SUBJECT
USE WILL PROVIDE FOR THE CONVENIENT PATRONAGE
OF THE PUBLIC WHEREBY THAT CONVENIENCE DOES
NOT ALREADY EXIST IN THE IMMEDIATE AREA,
SUBJECT TO THE CONDITIONS OF APPROVAL FOR
CONDITIONAL USE PERMIT NO. 5. 0715, HIGH-NOON
SALOON, FOR A COCKTAIL LOUNGE LOCATED AT 167
NORTH INDIAN CANYON DRIVE, CBD ZONE, SECTION
15.
WHEREAS, William H. Stoddard and Sean W. Collins, (the
"applicants") filed an application with the City pursuant to
Section 9402 . 00 of the Zoning ordinance for a Conditional Use
Permit for a cocktail lounge located at 167 North Indian Canyon
Drive, CBD Zone, Section 15; and
WHEREAS, notice of a public hearing of the Planning Commission of
the City of Palm Springs to consider the applicant's Application
for Conditional Use Permit No. 5 . 0715 was given in accordance with
applicable law; and
WHEREAS, on March 27 , 1996 a public hearing on the application for
Conditional Use Permit No. 5 . 0715 was held by the Planning
Commission in accordance with applicable law; and
WHEREAS, at the conclusion of its public hearing on March 27, 1996,
the Planning Commission adopted Resolution No. 4488, approving
Conditional Use Permit No. 5. 0715 subject to the findings and
conditions stated in said Resolution; and
WHEREAS, on April 17, 1996, a meeting on the application for
Conditional Use Permit No. 5. 0715 was held by the City Council
subject to Section 23958 .4 of the Business & Professional Code. The
meeting is for the Resolution of Public Convenience and Necessity
not the Conditional Use Permit; and
WHEREAS, the City Council has carefully reviewed and considered all
of the evidence presented in connection with the Resolution,
including but not limited to the staff report, and all written and
oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to Section 23958 .4 of the Business &
Professions Code, the City Council finds that:
a. Although there are other similar establishments in the
area, the subject use will add to the convenience and
necessity in the immediate area.

NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the
City Council hereby finds that the subject use will provide for the
convenience and necessity in the immediate area as required by the
Department of Alcoholic: Beverage Control. The City Council further
finds that the conditions adopted by the Planning Commission for
Conditional Use Permit No. 5 . 0715, are deemed necessary for the
protection of the public health, safety, and welfare of the
community. '
