HomeMy WebLinkAbout18794 - RESOLUTIONS - 3/20/1996 RESOLUTION NO. 18794 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, VACATING ALL OF THE RIGHT TITLE AND INTEREST OF SAID CITY IN PART OF THE RIGHT-OF-WAY FOR TACHEVAH DRIVE IN SECTION 7, T.4S.,R.5E.,S.B.B. ' &M. WHEREAS, the City Council of the City of Palm Springs is authorized by the Public Streets, Highways and Service Easements Vacation Law, Part 3, Division 9, of the Streets and Highways Code of the State of California to vacate and close to public use streets or parts of streets within the limits of said City; and WHEREAS, heretofore the City Council did adopt a resolution declaring its intention to vacate and close a part of the right-of-way for a portion of Tachevah Drive and a notice of the public hearing was posted and published as required by the statute, and did hold a public hearing as required by statute; and WHEREAS, the City's Planning Commission has determined that the said vacation is not in conflict with the City's General Plan; and WHEREAS, the City Council found from all evidence submitted that said right-of-way for a portion of Tachevah Drive is unnecessary for present or prospective public street purposes and that it is in the public interest that said public right-of-way be vacated. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, as follows: Section 1. That the City Council does hereby vacate, subject to Section 2 hereof, all the City's right, title and interests in and to that portion of the right-of-way for a part of Tachevahi Drive described and shown on Exhibit "A" attached hereto a made a part hereof, being within said City of Palm Springs, County of Riverside, State of California. Section 2. That the City reserves and accepts from the foregoing vacation an easement to operate and maintain sewers, drains, pipelines, cables, wires and any other easements of any governmental and public agencies or utility corporations existing in, under, or over the vacated/vacation area unless Quit Claimed or released by the owner thereof. Section 3. That the City Clerk is hereby directed to cause a certified copy of this resolution, attested to by her under the seal of the City, be recorded in the office of the County Recorder of Riverside County. The City Clerk is further directed to transmit a certified copy of this resolution to the County Surveyor of Riverside County.
