HomeMy WebLinkAbout18787 - RESOLUTIONS - 3/6/1996 REESOLUTION NO. 18787 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, UPHOLDING THE PLANNING COMMISSION DECISION CONCERNING CASE 3 . 1142 TO ALLOW THE REMOVAL OF ANY OF, OR ALL, (SEVEN TREES WITHIN THE COMMON AREA OF THE TWIN PALMS HOMEOWNERS ASSOCIATION LOCATED WEST OF ' 1223 TWIN PALMS DRIVE, R-1-C ZONE, SECTION 23 . WHEREAS, Lorraine Lawrence filed an appeal of the Planning Commission approval of Case 3 . 1.142 that would allow the :removal of seven trees as requested by the Twin Palms Homeowners Association (TPHOA) (subject to conditions) ; and WHEREAS, the Planning Commission considered and approved the application at its regular meeting held on January 10, 1996; and WHEREAS, the City Council of the City of Palm Springs considered the appeal of Case 3 . 1142 on March 6, 1,996, in accordance with applicable law; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including but not limited to the staff report, all written and oral testimony presented. THE CITY COUNCIL HEREBY FIENDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council that this ' project is Categorically exempt from California Environmental Quality Act Guidelines. Section 2 : Pursuant to Zoning Ordinance Section 9402 . 00, the City Council finds that: a. The proposed tree removal and replacement at the location set forth :in the application is properly one for which a Minor Architectural Review Application is authorized by the City's Zoning Ordinance. b. The proposed tree removal and enhancement could be necessary or desirable for the continued maintenance of the development, and is not detrimental to the: existing or future uses of the common area. C. The proposed tree removal and replacement could enhance vistas, augment open space, and afford better use of the space by the residents. d. The proposed tree removal and replacement is consistent with the General :Plan and will complement the maintenance of existing and proposed uses. f. The conditions imposed are deemed necessary to protect the public health, safety and general welfare, of the neighborhood in which this project is situated. Page2 P QC Page 2 NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby upholds the Planning Commission approval of Case 3 . 1142 subject to replacing all trees removed with tress of suitable and rapid growth characteristic. ADOPTED this 6'th day of March , 1996.
