OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, FINDS THAT THE SUBJECT
USE WILL PROVIDE FOR THE CONVENIENT PATRONAGE
OF THE PUBLIC WHERE13Y THAT CONVENIE19CE DOES '

SUBJECT TO THE CONDITIONS STA`'ED FOR
CONDITIONAL USE PERMIT NO. 5. 0696, TO UNOCAL
STATION, FOR THE SALE; OF BEER AND WINE; LOCATED
AT 19995 N. INDIAN CANYON DRIVE, H•-C ZONE,
SECTION 15 .
WHEREAS, Unocal, (the "applicant") has filed an application with
the City pursuant to Section 9402 . 00 of the Zoning Code for the
sale of beer and wine located at 19995 N. Indian Canyon Dr. , H-C
Zone, Section 15; and
WHEREAS, notice of a public: hearing of the Planning Commission of
the City of Palm Springs to consider Applicant's Application for
Conditional Use Permit; No. 5 . 0696 was given in accordance with
applicable law; and
WHEREAS, on July 12 , 1995 a public hearing on the application for
Conditional Use Permit No. 5. 0696 was held by the Planning
Commission in accordance with applicable law; and
WHEREAS, at the conclusion of its public hearing on July 12 , 19951 '
the Planning Commission adopted Resolution No. 4459 , approving
Conditional Use Permit No. 5. 0696 which included the sale of beer
and wine subject to the findings and conditions stated in
Resolution No. 4459 ; and
WHEREAS, on February 21, 1996 a meeting on the application for
Conditional Use Permit; No. 5 . 0696 was held by the City Council
subject to Section 23958 . 4 of the Business & Professional Code; and
WHEREAS, the City Council has carefully reviewed and considered all
of the evidence presented in connection with the hearing on the
project, including but: not limited to the staff report, and all
written and oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant t:c Section 23958. 4 of the Business &
Professions Code, the City Council finds that:
a. That the subject use will provide for the convenient
patronage of the public whereby the convenience does not
already exist in the immediate area.

NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, Y
the City Council hereby finds that the subject use will provide for
the convenient patronage of the public whereby the convenience does
not already exist in the immediate area for Conditional Use Permit
No. 5. 0696, subject to those conditions approved at the July 12,
1995, Planning Commission meeting set forth in Exhibit A, on file
in the Department of Planning & Building's office.
