HomeMy WebLinkAbout18770 - RESOLUTIONS - 1/17/1996 RESOLUTION NO. 18770 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, OVERRULING THE PLANNING COMMISSION AND APPROVING THE REQUEST TO SCREEN THE SERVICE AREA WITH LANDSCAPING AS PROPOSED FOR THE GIVENCHY SPA AND RESORT LOCATED AT THE NORTHWEST CORNER OF E. ' PALM CANYON DRIVE AND CHEROKEE WAY, PD 58, SECTION 30. WHEREAS, the City has received a request by the Givenchy Spa and Resort (the "applicant) for approval of landscape plans to screen the service area for case 5. 927-B for the Givenchy Spa and Resort at the northwest corner of E. Palm Canyon Drive and Cherokee Way, PD 58, Section 30; and WHEREAS, the Planning commission considered the request at its regular meetings on December 27, 1995; and WHEREAS, the Planning Commission recommended approval of the landscape plans subject to construction of a masonry wall and that the applicant submit a revised landscape plan for staff approval on December 27 , 1995; and, WHEREAS, the City Council considered the request at its regular meeting on January 17, 1996; and, WHEREAS, the request entails screening the service area with landscaping instead of a masonry wall as originally approved; and, ' WHEREAS, the City Council has carefully reviewed and considered all the evidence presented in connection with the Project, including but not limited to the staff report, all environmental data including the initial study, the Negative Declaration and all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council finds as follows: The project was previously assessed with respect to the California Environmental Quality Act such that the proposed modifications would not warrant the need of a new environmental assessment. Section 2 : Pursuant to the 'Zoning Ordinance Section 9402 . 00, the City Council finds that: a. The project is based upon the applicant's submittal of a landscape plan that screens the service area from public view. b. The service area has not been modified as apart of the project. C. The intensity of the service area will drop since the intensity of the hotel and spa have been reduced from the previous hotel use. d. The proposed landscape plan includes plant material which is not subject to frost damage and that a solid screen hedge will adequately screen the service area. Id R18770 /cli Page 2 NOW, THEREFORE, BE IT RESOLVED that, based capon the foregoing, the City Council hereby overrules the Planning Commission and approves the request to allow a landscape screen instead of a masonry wall for the screening of the service area proposed for Case 5 . 927-B.
