OF THE CITY COUNCIL OF THE CITY OF PALM[ SPRINGS,
CALIFORNIA, APPROVING THE ACQUISITION OF RIGHT-
OF-WAY FOR THE SUNRISE WAY/E. PALM CANYON '
DRIVE WIDENING PROJECT, CITY PROJECT NO. 92-35,
ALONG THE NORTH SIDE OF E. PALM CANYON DRIVE
LYING WEST OF SUNRISE WAY AND CALLE DE MARCUS
IN SECTION 23.

WHEREAS acquisition of right-of-way is necessary for the Sunrise Way/E. Palm Canyon Drive
widening project, City Project No. 92-35, and
WHEREAS additional right-of-way is needed along the north side of E. Palm Canyon Drive
from two property owners, and
WHEREAS the two properties affected are:
1. Property along the north side of E. Palm Canyon Drive between Sunrise Way and
Calle De Marcus designated as the Caribbean Apartment's property, described
and shown on a map marked Exhibit "A" attached hereto and made part hereof,
which has been given a fair market value of $24,000 by an MAI appraiser
retained by the City to appraise the property.
2. Property located at the northwest corner of E. Palm Canyon Drive and Calle De '
Marcus designated as the Bee Charmer Inn property, described and shown on
Exhibit "B" attached hereto and made a part hereof, which has been given a fair
market value of$4,400 by an MAI appraiser retained by the City to appraise the
properly, and
WHEREAS the owner of the Caribbean Apartments has agreed to sell the City the land needed
for the project for the sum of $24,000, in addition the City is to re-]landscape the area between
the front of the building and the new curb line, slurry seal the parking lots on the east and west
side of the apartments, and pay all title and escrow fees connected with the acquisition of the
property, and
WHEREAS the owner of the Bee Charmer Inn has agreed to sell the City the land needed for
the project for the sum of $4,400 and the City is to pay all title and escrow fees in connection
with the acquisition of the property.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs,
California, as follows:
Section 1. That the City Council approves the acquisition of the land designated as the
Caribbean property along the north side of E. Palm Canyon Drive between '
Sunrise Way and Calle De Marcus, described and shown on Exhibit "A" attached
hereto and made a part hereof for the sum of $24,000, re-landscape the area
between the front of the building and the new curb ]fine, slurry seal the parking
lots on the east and west sides of the apartments and pay all title and escrow fees
in connection with the acquisition of the property. 9A

Section 2. That the City Council approves the acquisition of the property designated as the
' Bee Charmer Inn property at the northwest corner of E. Palm Canyon Drive and
Calle De Marcus, described and shown on Exhibit "B" attached hereto and made
a part hereof for the sum of $4,400 and pay all title and escrow fees charged in
connection with the acquisition of the property.
Section 3. That the City Manager and City Clerk are hereby authorized to sign all
documents approved by the City Attorney on behalf of the City of Palm Springs
necessary to consummate he acquisition of the said land.
Section 4. That the City Clerk is hereby authorized to accept a deed for each parcel and
arrange for it to be recorded in the county recorder's office on behalf of the City
of Palm Springs.
