HomeMy WebLinkAbout18730 - RESOLUTIONS - 11/15/1995 RESOLUTION NO. 18730 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN TO ALLOW THE THREE EXISTING, SINGLE-FAMILY HOUSES ALONG WEST TAHQUITZ CANYON WAY TO CONVERT TO BED-AND-BREAKFAST INNS OR OTHER SIMILAR TOURIST FACILITIES WITH A PLANNED DEVELOPMENT DISTRICT AND THE FUTURE ESTABLISHMENT OF A STREET IMPROVEMENT PLAN FOR WEST TAHQUITZ CANYON WAY, COMMENCING AT MUSEUM DRIVE . WHEREAS, the City of Palm Springs has initiated a General Plan Amendment to amend the Land Use Element to create a special district for the West Tahquitz Canyon area allowing for the conversion of three existing single-family dwellings to bed-and- breakfast inns or other similar tourist facilities with an approved Planned Development District; and WHEREAS, the General Plan Amendment also entails language which will encourage, in the future when new development warrants, surrounding property owners on West Tahquitz Canyon Way (west of Museum Drive) to establish and implement a street improvement plan to divert traffic to Museum Drive from West Tahquitz Canyon Way and ' create the potential for on-street parking along the west end of West Tahquitz Canyon Way; and WHEREAS, the subject Low-Density-Residential area is uniquely located adjacent to the Central Business District which entails such uses as the Desert Museum, the Desert Fashion Plaza and a restaurant all within 500 feet of the subject property such that the potential bed-and-breakfast inns will be appropriately located; and WHEREAS, the proposed General Plan Amendment is consistent with Policy 3 . 17 . 12 of the Land Use Element which states that high- quality residential, resort or hotel development is appropriate at the westerly terminus of Tahquitz Canyon Way; and WHEREAS, the Planning Commission reviewed the subject General Plan Amendment for discussion purposes only at a regularly scheduled study session on September 20, 1995; and WHEREAS, the Planning Commission voted to recommend approval of the subject General Plan Amendment by a vote of 6-0 ; 1 abstention at a public hearing on October 25, 1995; and WHEREAS, an Environmental Assessment was prepared for the project in compliance with the California Environmental Quality Act (CEQA) concluding the project will not have a negative impact on the environment; and WHEREAS, notice of a public hearing of the City Council of the City of Palm Springs to consider the subject General Plan Amendment was given in accordance with applicable law; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the General Plan Amendment, including but not limited to the staff report . pp Page P 2 /�( Page 2 THE CITY COUNCIL HEREBY FINDS AS FOLLOWS : Section 1 : Pursuant to CEQA, the City Council finds as ' follows : a. The Negative Declaration has been completed in compliance with CEQA, the State CEQA Guidelines and the City' s CEQA procedures . The City Council has independently reviewed and considered the information contained in the Environmental Assessment/Negative Declaration and that on the basis of the Environmental Assessment and any comments received during the public review process as of this date, and in light of the whole record there will be no adverse environmental effects as a result of the approval of the project . The City Council further finds that the Environmental Assessment/Negative Declaration reflects its independent judgement . b. Pursuant to Fish and Game Code Section 711 .4, this project has a de minimis impact on fish and wildlife . NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby approves the amendment to the text of the General Plan, as shown on Exhibit A (as on file: in the Office of the City Clerk) , attached. W. Tahquitz Canyon Way. This isolated residential neighborhood on the edge of Downtown contains a unique mix of significant historic structures and custom homes of classic Modern architecture . Where access, circulation and other public facilities are adequate, the historic residences are appropriate for conversion to quality visitor-related residential uses consistent with the Downtown redevelopment policies; the low-density residential character of the neighborhood shall be retained. The development of a master plan for circulation is encouraged as properties are (re) developed to prevent the intrusion of through-traffic and to provide localized parking.
