HomeMy WebLinkAbout18720 - RESOLUTIONS - 11/1/1995RESOLUTION NO. 18720 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, VACATING ALL RIGHT, TITLE, AND INTEREST OF SAID CITY IN "LOT B" OF THAT SUBDIVISION MAP ENTITLED, "SUNTAN ESTATES", IN SECTION 23. WHEREAS the City Council of the City of Palm Springs is authorized by the Public Streets, Highways and Service Easements Vacation Law, Part 3, Division 9, of the Streets and Highways Code of the Stale of California, to vacate and close to public use streets or parts of streets within the limits of said City; and WHEREAS, heretofore the City Council did adopt a Resolution declaring its intention to vacate and close the hereinafter referred to Lot "B" in "Suntan Estates", and the City Council did post notice, as required by the statute, and did hold its public hearing as required by the statute; and WHEREAS, the Planning Commission has determined that the said vacation is not in conflict with the City's General Plan; and WHEREAS, the City Council found from all evidence submitted that the said right-of-way over said Lot "B" in "Suntan Estates" was and is unnecessary for present or prospective public street purposes and that it is in the public interest that the said public right-of-way be vacated. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, California, as follows: Section 1. That the City Council does hereby vacate all the City's right, title, and interest in that right-of-way described as follows: Lot "B" of that subdivision map entitled, "Suntan Estates, being a subdivision of a portion of the southerly 668 ft. of Lot 37, Section 23, of Palm Valley Colony Lands as shown by map on file in Map Book 14, Page 652, Records of San Diego County, said map filed for record June 18, 1952", in Map Book 25, Page 37, Records of Riverside County; a road within said City of Palm Springs, County of Riverside, State of California. Section 2. That the City reserves and accepts from the foregoing vacation any easements to operate & maintain sewers, drains, pipelines, cables, wires and any other easements of any governmental agency or utility corporation existing in, under, or over the vacated/vacation area unless quick -claimed or released by the owner thereof. Section 3. That the vacation is contingent on the adjacent property owners entering into and recording Drainage Facility Maintenance Agreements, in a from acceptable to the City Attorney. Section 4. That the City Clerk is hereby directed to cause a certified copy of this Resolution, attested by her under the seal of the City, to be recorded in the Office of the County Recorded of Riverside County. The City Clerk is further directed to transmit a certified copy of this Resolution to the County Surveyor of Riverside County. ADOPTED this 1st day of November , 1995.
