HomeMy WebLinkAbout18699 - RESOLUTIONS - 9/20/1995 RESOLUTION NO. 18699 OF THE CITY COUNCIL OF THE CITY OF 'PALM SPRINGS, CALIFORNIA, OVERRULING THE PLANNING COMMISSION AND APPROVING THE: REQUEST FOR THE PHARMACY AS PROPOSED, FOR A NEIGHBORHOOD SHOPPING CENTER EXPANSION LOCATED AT THE NORTHWEST CORNER OF SUNRISE WAY AND VISTA CHINO, CDN ZONE, SECTION 2 . ' WHEREAS, the City has received a request by Sunrise Square Partners (the "applicant) for approval of revised plans for case 5. 0646 for the Sunrise Square Shopping Center at the northwest corner of Vista Chino and Sunrise Way, CDN Zone, Section 2 ; and, WHEREAS, the Planning Commission considered the request at its regular meetings on May 10, 1995, July 5, 1995, July 26, 1995, and August 23 , 1995; and WHEREAS, the Planning Commission recommended approval of the pharmacy subject to the condition at its August: 23 , 1995 meeting; and, WHEREAS, the City Council considered the request at its regular meeting on September 20, 1995; and, WHEREAS, the request entails revising the north side of the existing pharmacy; and, WHEREAS, the City Council has carefully reviewed and considered all the evidence presented in connection with the Project, including but not limited to the staff report, all environmental data , including the initial study, the Negative Declaration and all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council finds as follows: The project was previously assessed with respect to the California Environmental Quality Act such that the proposed modifications would not warrant the need of a new environmental assessment. Section 2 : Pursuant to the Zoning Ordinance Section 9402 . 00, the City Council finds that: a. The project .is based upon the applicant's submittal of providing a trellis detail on the north elevation of the existing pharmacy. b. The existing north elevation currently faces the alley. Upon construction of the project, the new main entry will now be located directly north of the pharmacy and thus the existing backside (north elevation) will face the main driveway and new market. ' c. That the pharmacy submitted as proposed is consistent with the original conditional use permit application as approved by the City Council on October 20, 1993 . R18699 Page 2 NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby overrules the Planning Commission and approves the request to allow the pharmacy as proposed and subject to those applicable conditions set forth in Case 5. 0646.
