HomeMy WebLinkAbout18692 - RESOLUTIONS - 9/6/1995 RESOLUTION NO. 18692 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AUTHORIZING AND REQUESTING RIVERSIDE COUNTY TO RELEASE THOSE BONDS, OR OTHER DEPOSITS, HELD TO SECURE REMOVAL & RESTORATION AND REVEGETATION FOR WIND ENERGY PROJECTS NOW LOCATED WITHIN THE CITY OF PALM SPRINGS. WHEREAS the County of Riverside requires the posting of demolition and revegetation bonds in connection with the development of wind energy projects; and WHEREAS, in October 1994, several wind energy projects were annexed into the City of Palm Springs (Annexation #26) ; and WHEREAS the City believes that, after experience, the salvage value of the equipment is far greater than the cost of removing a wind energy project; and WHEREAS, in preparation for Annexation #26, the City advised the WECS developers that the posting of demolition bonds would not be required by the City as a condition of obtaining permits; and WHEREAS the City believes that, after experience, a demolished or redeveloped windpark will revegetate naturally rather quickly; and ' WHEREAS, in issuing a Land Use Permit and a Conditional Use Permit for a wind energy project since the annexation, the City did not require bonds for demolition and revegetation; and WHEREAS various developers of WECS projects have requested the release of the demolition and revegetation bonds held by the County; and WHEREAS the County has asked the City whether a transfer of these bonds to the City is desirable; and WHEREAS the County will not release the demolition and revegetation bonds without direction from the City Council. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: The City Council finds that: a. from experience, the salvage value of the wind energy equipment is far greater than the cost of removing a wind energy project; and b. from experience, a demolished or redeveloped windpark will revegetate naturally rather quickly; and ' C. there is no longer any purpose in holding cash deposits in lieu of salvage rights; and d. the City shall evaluate the future need for restoration and restoration bonds and for revegetation bonds as applications for new or redeveloped wind energy projects are evaluated. R18692 Page 2 _1� �t_a NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, v{ iY� the City Council hereby authorizes and requests the County of Riverside to release the demolition and revegetation bonds required as conditions of approval on the various wind energy projects now located in the City of Palm Springs.
