OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING PRELIMINARY
PLANNED DEVELOPMENT DISTRICT APPLICATION
5. 0694-PD-238 FOR DEVELOPMENT OF A 5. 9-ACRE
PARCEL FOR A CHURCH LOCATED AT 803 EAST PALM
CANYON DRIVE, R-3/R-2 ZONE, SECTION 26.
WHEREAS, the Palm Springs Presbyterian Church (the "Applicant") has
filed plans for Case 5. 0694-PD-238 for a Planned Development
District for a church located at 803 East Palm Canyon Drive; and
WHEREAS, the proposed church is located in the R-3/R-2 Zones for
which a Conditional Use Permit would normally be required; and
WHEREAS, the Planned Development District application has been
applied for to allow for the consideration of a high-rise building
and church; and
WHEREAS, the Initial Study performed by staff identified potential
impacts for which mitigation measures have been established; and
WHEREAS, notice of a public hearing of the Planning Commission of
the City of Palm Springs to consider the applicant's request for
Preliminary Planned Development District 238 was given in
accordance with applicable law; and
WHEREAS, the Planning Commission, at its regular meeting on July
2G, 1995, after listening to the public testimony, approved Case
5. 0694-PD-238; and
' WHEREAS, notice of a public hearing of the City Council of the City
of Palm Springs to consider Planned Development District 238 was
posted and mailed in accordance with applicable law; and
WHEREAS, on September 6, 1995, a public hearing on the application
for a Planned Development District 238 was held by the City Council
in accordance with applicable law; and
WHEREAS, the City Council has carefully reviewed and considered all
of the evidence presented in connection with the hearing on the
project, including but not limited to the staff report, and all
written and oral testimony presented.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City council finds as
follows:
The final Negative Declaration has been completed in
compliance with CEQA, the State CEQA Guidelines, and the
City's CEQA procedures contained in the City's CEQA
Guidelines. The Planning Commission has independently reviewed
and considered the information contained in the Negative
Declaration and finds that it adequately discusses the
significant environmental effects of the proposed project,
and that the mitigation measures adopted for this project
adequately reduce the impacts to less than significant, and
that, on the basis of the initial study and comments received
during the public review process, there is no substantial
evidence that there will be any significant adverse
environmental effects as a result of the approval of this
project. The Planning Commission further finds that the
Negative Declaration reflects its independent judgment.
Section 2 : Pursuant to Zoning Ordinance Section 9403 . 00, the
City Council finds that:

a. The proposed use is consistent with the applicable Zone
and General Plan guidelines and is properly one for which a
Planned Development is authorized by 1--he c:ity's zoning
ordinance.
b. That there is little or no probability the project will
be detrimental to or interfere with the existing and or future
development in the area and that the mitigation measures as '
established in the initial study will mitigate any potential
impacts to less than significant.
d. That the use applied for is desirable ,For the development
of the community, in that the future church will satisfy the
need of the congregation and the proposed multi-purpose
building will provide conference room area for local hotels.
e. That the site is adequate in size and shape to
accommodate the uses and all of the yards, walls or fences,
landscaping, and other features required in order to adjust
said use to those: existing or permitted future uses on the
subject property and in the neighborhood.
f. The conditions imposed on the project are deemed
necessary to protect the public, health, safety and. welfare.
g. A nexus and rough proportionality have been established
for the off-site improvements as related to the proposed
Planned Development District application.
The off-site improvements which are required by the Zoning
Ordinance are related to the project since the improvements
will provide acceptable pedestrian access on East Palm Canyon,
camino Real, and Twin Palms Road. Currently, the property is '
vacant and the lack of the off-site improvements creates an
unsafe walking condition for pedestrians traversing the site.
Existing and future congregation members will benefit from the
improvements required on the property along East Palms Canyon
Drive, Camino Real., and twin palms Road such as sidewalks. The
required improvements will provide safety benefits to the
surrounding property owners and members of the congregation
and will aesthetically enhance the neighborhood.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of
Palm Springs, California, hereby recommends approval of Preliminary
Planned Development District (PD) 238 (Case 5. 0694) , subject to
those conditions set forth in Exhibit "A" , which is on file at the
City Clerks Office and which have to be satisfied in full. prior to
issuance of certificates of occupancy unless otherwise specified.
