OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING FINAL
DEVELOPMENT PLANS FOR CASE 5. 0631-PD-227-A/TPM
27975 (PHASE I) TO ALLOW A COMMUNITY SHOPPING
CENTER ON THE SOUTHEAST CORNER OF SUNRISE WAY
AND VISTA CHINO C-S-C ZONE, SECTION 12 .
WHEREAS, the Palm Springs Center Limited (the "Applicant") has
filed Final Development Plans for Case 5. 0631-PD-227-A/TPM 27975
for Phase I of a Planned Development District to allow a Community
Shopping Center at the southeast corner of Sunrise Way and Vista
Chino; and
WHEREAS, the Planning Commission considered and recommended
approval, subject to conditions, of the Final Development Plans at
its special meeting on July 5, 1995; and
WHEREAS, the City Council considered the Final Development Plans at
its regular meeting on July 19, 1995; and
WHEREAS, the proposed revisions entail minor reconfiguration of pad
sites, relocation of buildings within the approved site, and minor
architectural modifications; and
WHEREAS, the proposed modifications are in keeping with the
approved preliminary Planned Development District application; and
WHEREAS, this application was assessed with respect to the
California Environmental Quality Act with the original approval of
' the Planned Development District application; and
WHEREAS, the shopping center is subject to all original conditions
of approval regarding Case 5. 0631-PD-227-A/TPM 27975 which are on
file at the Office of the City Clerk; and
WHEREAS, the City Council has carefully reviewed and considered all
of the evidence presented in connection with the hearing on the
project, including but not limited to the staff report and all
written and oral testimony presented at the hearing.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds as
follows:
The project was previously assessed with respect to the
California Environmental Quality Act such that the proposed
modifications would not warrant the need of a new
environmental assessment.
Section 2 : The approved Mitigation Monitoring Program adopted
for this shopping center pursuant to Public
Resource Code Section 21081. 6 is applicable to the
proposed modifications in order to assure
compliance with the adopted mitigation measures
during the project implementation.

Section 3 : Pursuant to Zoning Ordinance Section 9402 . 00, the
City Council finds that:
a. The proposed pad modifications, building relocations, and
minor architectural adjustments, are in keeping with the
approved preliminary Planned Development District application.
b. The shopping center is necessary for the development of '
the northern portion of the community as -the area north of
Tahquitz Canyon Way is currently served by only one retail
center and yet the area contains a large portion of the City's
residential area.
C. The proposed shopping center as modified is consistent
with the General Plan and in harmony with the various
elements/objectives of the General Plan.
d. The site of the proposed shopping center is served by
Vista Chino and Sunrise Way which are major thoroughfares
properly designed to carry the type and quantity of traffic to
be generated by the center.
e. The conditions imposed by virtue of the revised plan are
deemed necessary to protect the public, health, safety and
welfare.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of
Palm Springs, California, hereby approves the Final Development
Plans for Case 5. 0631-PID-227-A/TPM 27975 (Phase I) , subject to the
original conditions of approval and to those conditions :yet forth
in Exhibit "A" , which are on file at the office of the City Clerk
and which have to be satisfied prior to the issuance of
certificates of occupancy unless otherwise specified. '
