HomeMy WebLinkAbout18665 - RESOLUTIONS - 7/19/1995 RESOLUTION NO. 18665 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE CONSOLIDATED WITH THE GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 7, 1995 FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY, A REFERENDUM MEASURE CONCERNING THE AIRPORT EXPANSION. ' WHEREAS a Referendum petition against Resolution 18604 certifying the environmental impact report for the Airport Master Plan as complete, adopting corresponding statement of findings & facts and the mitigation monitoring program, and adopting the Airport Master Plan and the FAR Part Noise Compatibility Study&Program as the official Airport Master Plan, and adopting the related General Plan Text amendments, as adopted by the City Council on May 17, 1995; and WHEREAS the City Clerk has verified the signatures contained therein, and has certified that the petition qualifies under provisions of the California Elections Code, to enable the City Council to repeal the said resolution, or to submit same to a special election of the electorate of the City of Palm Springs; and WHEREAS the City Council desires to place said matter before the qualified voters of the City of Palm Springs; and WHEREAS a General Municipal election will be held in said City, on November 7, 1995, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, as follows: Section 1. That there shall be and there is hereby ordered a special municipal election, to be consolidated with the general municipal election to be held November 7, 1995, for the purpose of submitting to the qualified electors of said City, the following measure, to wit: MEASURE Shall the Airport Master Plan and its component parts and related General Plan Text amendments, as approved by the City Council on May 17, 1995, be adopted? Section 2. That such measure shall be designated on the ballot by a letter printed on the left margin of the square containing a description of the measure, as provided by Section 13116 of the Elections Code. In the event the measure receives a greater number of YES votes than NO votes, the measure shall be deemed approved by the voters. In the event a measure receives a greater number of NO votes than YES votes, the measure shall be deemed disapproved by the voters. Section 3. In all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding special municipal elections in said City. Section 4. Notice of time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or a additional notice of said election, in time, form and manner as required by law. Section 5. That the City Clerk shall transmit a copy of each measure referenced in Section 1 to the City Attorney and the City Attorney shall prepare an impartial analysis thereof showing the effect of measure on existing law and the operation of the measure.
