OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING TEMPORARY
CONDITIONAL USE PERMIT 5. 0697 FOR MISSION OF
THE GOOD SHEPHERD TO OPERATE A FOOD KITCHEN
LOCATED AT 550 INDUSTRIAL PLACE, C-M ZONE,
' SECTION 23 . - - - - - - - - - -
WHEREAS Mission of the Good Shepherd (Mission) has submitted an
application for a Conditional Use Permit (CUP) for purposes of
operating a food kitchen and ancillary functions at 550
Industrial Place; and
WHEREAS the Planning Commission, at its regular meeting of July
12 , 1995, failed to arrive at a recommendation regarding this
request for a CUP; and
WHEREAS on July 19, 1995, a public hearing on the subject CUP
application was held by the City Council in accordance with
applicable law; and
WHEREAS the City Council has carefully reviewed and considered
all of the evidence presented in connection with the hearing on
the project, including, but not limited to, the staff report.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds as
follows:
' a. The project is categorically exempt from the requirements of
CEQA pursuant to Section 15301, Existing Facilities.
b. Pursuant to Fish & Game Code Section 711.4, this project has
a de minimis impact on fish and wildlife.
Section 2 : The City Council finds that:
a. The proposed food kitchen facility is not an appropriate use
for the subject location.
b. Although the proposed food kitchen serves a necessary
function in the community, it is not in harmony with the
various elements of the General Plan, and it is detrimental
to existing or future uses specifically permitted in the
surrounding area.
C. The site is not adequate for the intended use.
d. The proposed use will not generate on-site vehicular and
pedestrian circulation in conflict with the surrounding
streets.
e. The proposed use is permitted to operate for a period of no
longer than ninety (90) days during which time such use
shall vacate the premises at 550 Industrial Place and
relocate to an appropriate site. A new application for a
CUP shall be made for the new site selected by the Mission.
e. The conditions to be imposed and shown in Exhibit A of this
resolution, on file in the Office of the City Clerk, are
deemed necessary to protect the public health, safety and
general welfare during the ninety-day period during which
this permit is in effect.

f. The fees paid for this application for a CUP shall be
credited toward an application for a CUP at another site.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing,
the City Council hereby approves temporary Conditional Use Permit
5. 0697 subject to those conditions set forth in Exhibit A, on
file in the Office of the City Clerk.
