OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING TIIE PRELIMINARY
AND FINAL PLANNED DEVELOPMENT DISTRICT
APPLICATION (CASE 5 . 0690-PD-2.37) SUBMITTED BY
THE CHURCH OF ST. PAUL IN THE DESERT FOR
BUILDING ADDITIONS TOTALLING 11, 813 SQUARE
FEET, 5, 692 SQUARE FEET OF COVERED WALKWAY, A
NEW PARKING LOT AND A REQUEST FOR A PARTIAL
STREET VACATION ESTABLISHING A REDUCED RIGHT-
OF-WAY ALONG PRESCOTT CIRCLE NORTH, LOCATED AT
125 WEST EL ALAMEDA, R-2, R-1-A AND RESORT
COMBINING ZONES, SECTION 10 .
WHEREAS, the Church of St . Paul in the Desert (the church) has
submitted an application for a preliminary and final Planned
Development District to add 11, 813 square feet of building
additions, 5 , 692 square feet of covered walkways and a new parking
lot; and
WHEREAS, the proposed on-site parking lot is located in an R-l-A
zone; and
' WHEREAS, the church is also requesting to vacate a portion of
Prescott Circle, creating a reduced right-of-way of 46 .4 feet,
which is consistent with the General Plan; and
WHEREAS, the Planned Development District application includes
.requests for flexibility regarding property development standards
such as required setbacks, screening walls, maximum height, minimum
distance between buildings and minimum landscape/open space
requirements ; and
WHEREAS the new additions will not be obtrusive to adjacent
properties due to existing and proposed landscaping and building
design; and
WHEREAS the church additions are exempt according to the California
Environmental Quality Act (CEQA) ; and
WHEREAS on May 24 , 1995, the Planning Commission voted to recommend
approval (6-0) of the preliminary and final Planned Development
District including a reduced right-of-way along a portion of
Prescott Circle; and
WHEREAS notice of a public hearing of the City Council of the City
of Palm Springs to consider the subject application for a
' preliminary and final Planned Development District was given in
accordance with applicable law; and
WHEREAS the City Council has carefully reviewed and considered all
of the evidence presented in connection with the hearing on the
project, including but not limited to the staff report .

THE CITY COUNCIL HEREBY FINDS AS FOLLOWS :
Section_1 : Pursuant to CEQA, the City Council .Finds as '
follows :
a. The project is categorically exempt from the requirements of
CEQA pursuant to Section 15301, Existing Facilities .
b . Pursuant to Fish and Came Code Section 71.1 .4, this project has
a de minimis impact on fish and wildlife.
Section 2 : Pursuant to Section 9403 . 00 of the Zoning Ordinance
the City Council finds that :
a. That the use applied for at the location set North in the
application is properly one for which a Planned Development is
authorized by the City' s Zoning Ordinance .
The proposed Planned Development District in lieu of a zone
change will allow for the expansion of the: existing church,
the expansion of the on-site parking lot and the reduction of
the right-of-way of Prescott Circle North.
b . That the said use is necessary or desirable for the
development of the community, is in harmony with the: various
elements or objectives of the General Plan, and. is not
detrimental to existing uses or to future uses specifically ,
permitted in the zones in which the proposed use is to be
located.
The General Plan policies encourage the development of
religious facilities in residential neighborhoods . The
proposed Planned Development District will allow for an
upgrade to the neighborhood due to the new church facility
additions, covered walkways and landscape additions . This
proposal will allow the church to better serve the community,
by allowing for more church seating capacity, additional class
rooms and meeting areas, better designed outdoor recreation
areas and additional on-site parking. The proposal will allow
for more architectural consistency among existing buildings
and proposed additions and will aesthetically enhance the
existing site as well as the neighborhood.
c . That the site for the intended use is adequate in size and
shape to accommodate said use, including yards, setbacks,
walls or fences, landscaping and other features required in
order to adjust said use to those existing or permitted future
uses of land in the neighborhood.
The proposed building and parking lot additions require
flexibility with regard to property development standards such '
as the front and west side setbacks, the required Landscape
percentage, the parking lot setbacks, the required parking lot
screening, building height, required space between buildings
and reduced on-site parking. The reduced property development
standards are such that the adjacent properties will not be
negatively impacted due to location and design of the
buildings and the proposed and existing landscaping. The
adjacent single family property is heavily screened with
masonry walls and landscaping such that no perceived

encroachment should occur. With regard to parking lot
' setbacks and screening, the parking lot will be screened with
landscaping and the street has low usage, as does the church
site except for Sunday mornings . All of the proposed
additions will enhance the property as well as the surrounding
neighborhood. Additional right-of-way improvements will be
installed such as sidewalks, a handicap ramp and curb and
gutter.
d. That the site for the proposed use relates to streets and
highways properly designed and improved to carry the type and
quantity of traffic to be generated by the proposed use .
The proposed vacation of a portion of Prescott Circle will
continue to be consistent with the General Plan which allows
for a minimum right-of-way of 36 feet for residential streets .
Although a portion of the right-of-way will be vacated, the
nature of the church use and the low volumes of traffic on the
surrounding local streets, result in no effect on the streets
which are designed to carry the traffic generated by the
existing church use . The right-of-way along the affected
portion of Prescott Circle will be reduced to 46 .4 feet which
will allow for two travel lanes, sidewalks and parking on one
side of the street .
e . That the conditions to be imposed and shown on the approved
' site plan or in Exhibit A of this resolution are deemed
necessary to protect- the public health, safety and general
welfare and may include minor modifications of the zone' s
property development standards .
f . A nexus and rough proportionality have been established for
the requirement of the dedication of the additional right-of-
way to the City and the off-site improvements as related to
the Planned Development District .
The dedication of a portion of E1 Alameda, the off-site
improvements and the future undergrounding of utilities, which
are required by City ordinances, are related to the project .
Regarding the right-of-way dedication, the church currently
owns a triangular shaped piece of property which includes the
intersection of El Alameda and Prescott Circle North. The
laird to be dedicated is currently used as if it were public
right-of-waV and is used for access by the church property.
Therefore, the dedication is related to the subject project .
The installation of the off-site improvements such as the
sidewalks, handicap ramps and curb and gutter will benefit and
be used by those accessing the church property. The future
undergrounding of utilities will provide safety benefits to
the property and will aesthetically enhance the site as well
' as the neighborhood.

NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the
City Council hereby recommends approval of preliminary and final ,
Planned Development District 237, Case No. 5 . 0690 subject to those
conditions set forth in the attached Exhibit A, as on file in the
Office of the City Clerk, which are to be satisfied prior to the
issuance of certificates of occupancy unless otherwise specified.
