HomeMy WebLinkAbout18613 - RESOLUTIONS - 6/7/1995 RESOLUTION NO. 18613 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING AN AMENDMENT TO THE COMMUNITY DESIGN ELEMENT OF THE GENERAL PLAN TO PROVIDE REVISED STANDARDS FOR AUTO SERVICE STATIONS. WHEREAS the City of Palm Springs has received numerous requests for multiple "automobile service stations at certain street intersections and for mini-marts in conjunction with automobile service stations; and WHEREAS the City of Palm Springs has initiated and prepared a General Plan ' Amendment in favor of allowing multiple automobile service stations at certain intersections and allowing mini-marts in conjunction with automobile service stations; and WHEREAS an environmental assessment was prepared for the proposed project, resulting in the preparation of a negative declaration, and the approval of the subject project will not create any significant environmental impacts; and WHEREAS the City of Palm Springs Planning Commission held a public hearing on March 22, 1995, to receive and consider public testimony regarding an amendment 'to the Community Design Element of the General Plan to provide revised standards for automobile service stations; and WHEREAS the Planning Commission reviewed all evidence provided ' including the staff reports and all other written and oral testimony consistent with the requirements of the City and State law; and WHEREAS the City Council received due discussion and deliberation of said Negative Declaration, General Plan Amendment, and the comments, suggestions and objections elicited at a public hearing on April 19, 1995; and WHEREAS the City Council referred an additional portion of proposed text to the Planning Commission for its review; and WHEREAS the Planning Commission recommended approval of the additional portion of proposed text at its meeting of May 11, 1995; and WHEREAS the City Council received due discussion and deliberation of said Negative Declaration and the General Plan Amendment at a public meeting on June 7, 1995. ac.1 P18613 Rca. Gage 2 NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby approves the amendment to the text of the General Plan, as shown on Exhibit A, attached. The following mitigation measures shall be applied ' to automobile service stations: a. limit the location of service stations to one per street intersection, except in areas designated Highway Commercial or at intersections with exceptionally-high traffic levels; b. access must not be disruptive to the operation of the streets; C. all storage and accessory sales shall be entirely within an enclosed building; and d. functions shall be limited to the sale of gas, oil and accessories, except for locations containing a mini-mart, with only simple repairs which do not involve noise, odor, smoke or vibration. e. the approval of a mini-mart in conjunction with an automobile service station is discretionary based upon the adequacy of the site in size and shape to accommodate the use, the proper relationship of the use to the streets serving the site, the proper relationship of the use and its site to the surrounding neighborhood, and the maintenance of the health, safety and welfare of the community. 1 i a��
