HomeMy WebLinkAbout18579 - RESOLUTIONS - 4/5/1995 RESOLUTION NO. 18579 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, UPHOLDING THE ISSUANCE OF A NOTICE OF VIOLATION BY THE COMMUNITY PRESERVATION OFFICER TO HARRISON L. LEY FOR PROPERTY LOCATED AT 613 BEVERLY DRIVE, R-1-C ' ZONE, SECTION 24 . WHEREAS, on February 14, 1995, a complaint was received regarding auto repair and the storage of the travel trailer on property owned by Harrison L. Ley ( "Property Owner") and located at 613 Beverly Drive; and WHEREAS the Community Preservation Officer observed, between February 27 and March 2 , a swing-type apparatus (used for lifting engines and other automotive parts) and a travel trailer parked in the front yard of said property; and WHEREAS a Notice of Violation ("Notice") was sent, by both certified and regular mail, on March 7, 1995, requiring compliance with Municipal Code Chapter 11 . 96 regarding the parking and storage of the travel trailer, and requiring the removal of the swing-type apparatus from public view pursuant to Municipal Code Section 11 . 72 . 170 ; and WHEREAS, on March 20, 1995 , the Community Preservation Officer observed that the swing-type apparatus had been removed from public view and that the travel trailer had been moved to the street and was attached to a vehicle; and ' WHEREAS, on March 28, 1995, the travel trailer was again parked in the driveway the subject property; and WHEREAS the City Clerk received a letter from the Property Owner, dated March 15, 1995, appealing the issuance of said Notice on the grounds that the Property Owner is being subjected to selective enforcement; and WHEREAS the City Council has carefully reviewed and considered all of the evidence presented in connection with said appeal, including, but not limited to, the staff report and all written and oral testimony presented at a hearing during its meeting of April 5 , 1995 . THE CITY COUNCIL HEREBY FINDS AS FOLLOWS : Section 1 : The Community Preservation Officer appropriately issued the Notice of Violation to the property owner, Harrison L. Ley, in response to violations of the Municipal Code at 613 Beverly Drive . Section 2 : The process by which said Notice was issued conforms to the regulations set forth by the Municipal Code and did not substantially differ from the process by which notices of violation are issued to any other property owner. Section 3 : There exist reasonable means for the abatement of the violations for which the Notice of Violation was issued. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council hereby upholds the issuance of said Notice of Violation to Harrison L. Ley, property owner, for violations of the Municipal Code, as stated in said Notice, at 613 Beverly f 1N57? - � Drive; and NOW BE IT FURTHER RESOLVED that the subject violations must be corrected within 10 days from the date of this resolution.
