HomeMy WebLinkAbout18531 - RESOLUTIONS - 12/21/1994 RESOLUTION NO. 18531 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADOPTING THE NONDISPOSAL FACILITY ELEMENT ' WHEREAS, Public Resources Code (PRC), Section 41730 et. seq. requires each city and county to prepare and adopt a Nondisposal Facility Element (NDFE) for all new and existing nondisposal facilities which will be needed to implement local Source Reduction and Recycling Elements; and WHEREAS, Public Resources Code Section 40151 defines a nondisposal facility as any solid waste facility required to obtain a solid waste facility permit other than solid waste disposal and transformation facilities; and WHEREAS, Public Resources Code Sections 41734 (a) and (b) requires each city and county to submit their NDFE to the Local Integrated Waste Management Task Force for review and comment prior to adoption by the City Council; and WHEREAS, Public Resources Code Sections 41730, 41731 and 41791.5 states that the NDFE is to be submitted to the California Integrated Waste Management Board for review and approval following Local Task Force and City Council adoption. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs, California, as follows: Section 1. That the city has developed an NDFE which includes all permitted ' nondisposal facilities currently utilized by the city. Section 2. That the City of Palm Springs' NDFE has been reviewed by the Riverside County Solid Waste Management Advisory Council. Section 3. That the City Council of the City of Palm Springs approves the NDFE and agrees to submit it to the State of California Integrated Waste Management Board for review and approval. Section 4. That the City Clerk shall certify to the adoption of this resolution. ADOPTED this 21st day of December , 1994.
