OF THE CITY COUNCIh OF THE CITY OF PALM
SPRINGS, CALIFORNIA, GRANTING, SUBJECT TO THE
ORIGINAL CONDITIONS, FINAL PLANNED DEVELOPMENT
DISTRICT 233 .FOR A TIME SHARE FACILITY AT 1177
NORTH PALM CANYON DRIVE, R-2/C-1 ZONES, '
SECTION 1.0.
WHEREAS, John King (the. "Applicant") received preliminary Planned
Development approval to convert an existing hotel into time share
condominiums ("the project") pursuant to Section 9403 . 0�O of the
Zoning Ordinance, located at: 1177 North Palm Canyon Drive, R-2/C-1
Zones, Section 10; and
WHEREAS, notice of a public hearing of the Planning Commission and
the City Council of 'the City of Palm Springs to approve an
application for Planned Development District 233 were held in
accordance with applicable law; and
WHEREAS, the City Council of the City of Palm Springs granted
approval of the preliminary Planned Development District
application at its regular- meeting on September 21, 1994 .
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant: to CEQA, the Project is categorically
exempt from the requirements of` CEQA pursuant to
Section 15301.E.2 .
Section 2 : Pursuant: to Zoning Ordinance Section 9403 . 00, the '
City Council finds that:
a. The time-share use applied for at the location set forth
in the application is properly one for which a planned
development district is authorized by the City's Zoning
Ordinance.
b. The time-share use applied for is necessary or desirable
for the development of the community, and is not detrimental
to existing uses or to future uses specifically permitted in
the zones in which the. proposed use is to be located.
C. The proposed time-share use is consistent with existing
Zoning designations and will complement the growing health
care industry in -the neighborhood,
d. That the proposed use is consistent with the proposed
Draft General Plain.
e. The site for the intended use is adequate in size and
shape to accommodate said use, including yards, setbacks,
walls or fences, landscaping and other features required in
order to adjust said use to those existing or permitted future ,
uses of the .land in the neighborhood.
g. The site for the proposed use relates to streets and
highways properly designed and improved to carry the type and
quantity of traffic to be generated by the proposed use.

h. The conditions to be imposed are deemed necessary to
protect the public health, safety and general welfare,
including any minor modifications of the zones' property
development standards.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the
City Council hereby approves Final Planned Development District
(Case 5. OG73-PD-233) subject to those conditions set forth in the
attached Exhibit A, which are on file at the office of the City
Clerk and which have to be satisfied prior to the issuance of a
Certificate of Occupancy unless otherwise specified.
