CONDITIONS OF APPROVAL
October 19, 1994
Before final acceptance of the project, all conditions listed below
shall be completed to the satisfaction of the City Engineer, the
Director of Planning, the Chief of Police, the Fire Chief or their
designee, depending on which department recommended the condition.
Any agreements, easements or covenants required to be entered into
shall be in a form approved by the City Attorney.
PLANNING:
1. The proposed development of the premises shall conform to all
applicable regulations of the Palm Springs Zoning Ordinance,
Municipal Code, or any other City Codes, ordinances and
resolutions which supplement the zoning district regulations.
2 . The owner shall defend, indemnify, and hold harmless the City
of Palm Springs, its agents, officers, and employees from any
claim, action, or proceeding against the City of Palm Springs
or its agents, officers or employees to attach, set aside,
void or annul, an approval of the City of Palm Springs, its
advisory agencies, or legislative body concerning Case 5. 0666-
PD 231. The City of Palm Springs will promptly notify the
applicant of any such claim, action, or proceeding against the
City of Palm Springs and the applicant will either undertake
defense of the matter and pay the City's associated legal
costs. If the City of Palm Springs fails to promptly notify
the applicant of any such claim, action or proceeding or fails
to cooperate fully in the defense, the applicant shall not, J
thereafter, be responsible to defend, indemnify, or hold
harmless the City of Palm Springs. Notwithstanding the

foregoing, the City retains the right to settle or abandon the
matter in that the applicant's consent, but should it do so,
the City shall waive the indemnification herein, except, the aa,
City's decision to settle or abandon a matter following an
adverse judgement, or failure to appeal shall not cause a
waiver of the indemnification rights herein. >

3 . The final development plans for each phase of development �' •'-
shall be submitted in accordance with Section 9403 . 00 of the
Zoning Ordinance. Final development plans shall include site
plans, building elevations, floor plans, roof plans, grading
plans, landscape plans, irrigation plans, exterior lighting
plans, sign program, mitigation monitoring program, site cross
sections, property development standards and other such
documents as required by the Planning Commission. Final
development plans shall be submitted within two (2) years of
the City Council approval of the preliminary planned
development district. Additional conditions regarding final
development plans may be warranted upon review and approval of
final development plans.
4 . Final landscaping, irrigation, exterior lighting, and fencing
plans shall be submitted for approval by the Department of
Planning and Building prior to issuance of a building permit.
Landscape plans shall be approved by the Riverside County
Agricultural Commissioner's office prior to submittal.

4A. Final landscaping plans shall increase the use of transition
and arid landscape through out the project including the hotel
and VOU's. This landscape modification shall be shown on the
final plans.
5. The project is subject to the City of Palm Springs Water
Efficient Landscape Ordinance. The applicant shall submit an
application for Final Landscape Document Package to the
Director of Planning and Building for review and approval
prior to the issuance of a building permit. Refer to Chapter
8 . 60 of the Municipal Code for specific requirements.
6. The project is located in an area defined as having an impact
on fish and wildlife as defined in Section 711. 4 of the Fish
and Game Code and an Environmental Impact Report is being
prepared on the project; therefore a fee of $850. 00 plus an
administrative fee of $50. 00 shall be submitted by the
applicant in the form of a money order or a cashier's check
payable to the Riverside County Clerk prior to Council action
on the project. This fee shall be submitted by the City to
the County Clerk with the Notice of Determination. Action on
this application shall not be final until such fee is paid.
7 . Prior to issuance of a grading permit, a Fugitive Dust and
Erosion Control Plan shall be submitted and approved by the
Building Official. Refer to Chapter 8 . 50 of the Municipal
Code for specific requirements.
S . The mitigation measures of the environmental impact report are
adopted as conditions of approval. The applicant and City
shall enter into a monitoring program as outlined in the EIR.
9 . The hotel, temporary clubhouse for Phase I, permanent
clubhouse, tennis complex, Vacation Ownership Units, and all
research development, commercial/retail and industrial
buildings shall be subject to architectural review per Section
2 . 0 of the Zoning Ordinance. Appeals shall be processed
through the Planning Commission with no fee applicable. Cd^
Appeals to City Council shall be pursuant to the Municipal �,�
Code requirements and applicable fees. ,
10. A Conditional Use Permit shall be obtained for any major event - �N
associated with the golf course or the tennis facility. A E9
blanket CUP for annual events may be considered by the
Planning Commission. ' °�
11. All roof mounted mechanical equipment shall be screened from
all possible vantage points both existing and future per
Section 9303 . 00 of the Zoning Ordinance. The screening shall r
be considered as an element of the overall design and must (J a:"
blend with the architectural design of the building(s) . The c'_ ;`a
exterior elevations and roof plans of the buildings shall
indicate any fixtures or equipment to be located on the roof CO
of the building, the equipment heights, and type of screening.
Parapets shall be at least 6" above the equipment for the
purpose of screening.
12 . Prior to issuance of a grading permit, Fringe Toed Lizard
Mitigation fees shall be submitted.
13 . Prior to issuance of a building permit, the applicant must
provide a standard avigation easement and non-suit covenant in
a form prescribed and approved by the City Attorney, with
reference to present and future owners of the parcel.
14 . Construction of any Vacation Ownership Unit shall meet minimum
soundproofing requirements prescribed pursuant to Section 1092
and related sections of Title 25 of the California
Administrative Code. Compliance shall be demonstrated to the
satisfaction of the Director of Building and Safety.
15. The applicant prior to issuance of building permits shall
submit a draft declaration of covenants, conditions and
restrictions ("CC&R's") to the Director of Planning and
Building for approval in a form to be approved by the City
Attorney, to be recorded prior to issuance of occupancy
permits. The CC&R's shall be enforceable by the City, shall
not be amended without City approval, shall require
maintenance of all property in a good condition and in
accordance with all ordinances and conditions of approval.
16. Separate architectural approval and permits shall be required
for all signs. A detailed sign program shall be submitted for
review and approval by the Planning Commission prior to
issuance of building permits.
17 . The grading plan shall show the disposition of all cut and
fill materials. Limits of site disturbance shall be shown and
all disturbed areas shall be fully restored or landscaped.
18 . All materials on the flat portions of the roof shall be earth
tone in color.
19 . Perimeter walls shall be designed, installed and maintained in
compliance with the corner cutback requirements as required in
Section 9302 . 00.D.
20. The street address numbering/lettering shall not exceed eight
inches in height.
21. Manufacturer's cut sheets of all exterior lighting on any
building, in the golfcourse landscaping, and in any parking
lot shall be submitted for approval prior to issuance of a
building permit.
22 . Submit plans meeting City standard for approval on all
proposed trash and recyclable materials enclosure prior too
issuance of a building permit.
23 . This project shall be subject to Chapters 2 . 24 and 3 . 37 of the
Municipal Code regarding public art. The project shall either V\`
provide public art or payment of a fee. The provision of artI
or the fee shall be based upon the total value of work of 1/2%
(commercial) or 1/4% (residential with first $100, 000 of total
valuation for individual single-family units exempt) . Should
the fee be utilized to locate the public art on the project
site, said location shall be reviewed and approved by the
Director of Planning and Building and the Public Arts `• =.
Commission.
24 . Drainage swales shall be provided adjacent to all curbs and
sidewalks - 3 ' wide and 611 deep. The irrigation system shall
be field tested prior to final approval of the project.
Section 14 . 24 . 020 of the Municipal Code prohibits nuisance
water from entering the public streets, roadways or gutters.
The drainage swales shall be noted in grading plans.
25. Handicapped accessibility shall be indicated on the site plan
to include the location of handicapped parking spaces, the
main entrance to the proposed structure and the path of travel
to the main entrance. Consideration shall be given to
potential difficulties with the handicapped accessibility to
the building due to the future grading plans for the property.
26. The design, height, texture and color of fences and walls
shall be submitted for review and approval prior to issuance
of building permits.
27 . Texture, materials, and colors to be used on the proposed
building(s) , fences and walls shall be submitted for review
and approval prior to issuance of building permits.
28. No sirens, outside paging or any type of signalization will be
permitted, except approved alarm systems and golf starter.
29 . No outside storage of any kind shall be permitted except as
approved as a part of the proposed plan.
30. Vehicles associated with the operation of the proposed
development including company vehicles or employees vehicles
shall not be permitted to park off the proposed building site
unless a parking management plan has been approved.
31. Prior to the issuance of building permits, locations of all
telephone and electrical boxes must be indicated on the
building plans and must be completely screened and located in
the interior of the building. Electrical transformers must be
located toward the interior of the project maintaining a
sufficient distance from the frontage(s) of the project. Said
transformer(s) must be adequately and decoratively screened.
32 . The applicant shall provide all tenants with Conditions of
Approval of this project.
33 . No exterior downspouts shall be permitted on any facade on the
proposed building(s) which are visible from adjacent streets
or residential and commercial areas.
34 . Loading space facilities shall be provided in accordance with
Section 9307 . 00 of the Zoning Ordinance. Said facilities
shall be indicated on the site plan and approved prior to
issuance of building permits. \"
35. The project plans shall comply with Section 9306. 00 of the
Zoning ordinance regarding parking standards. Special
attention shall be focussed on compliance with the following
parking standards: landscape islands, tree wells, shading
percentage, parking lot lighting levels, location of light C
fixtures, parking stall measurements and striping, designation
of compact and handicapped parking spaces, curb, pedestrian
walkway locations and dimensions.
36. Architectural approval shall be valid for a period of two (2)
years for specific plans for any vertical improvement.
Extensions of time may be granted by the Planning Commission
upon demonstration of good cause.
37 . All awnings shall be maintained and periodically cleaned.
38. The project shall comply with the City of Palm Springs
Transportation Demand Management (TDM) Ordinance which
establishes transportation demand management requirements for
the City of Palm Springs. Refer to Chapter 8 . 4 of the
Municipal Code for specific requirements. The TDM Plan shall
consider and implement mitigation measures where feasible.
39. The Planned Development District shall supersede Conditional
Use Permit 5. 0599 which was approved at the southeast corner
of Vista Chino and Gene Autry Trail.
40. The applicant shall set aside a one acre site for fire station
purposes or provide an alternative one acre site on another
property acceptable to the Palm Springs Fire Department. The
applicant shall provide the City of Palm Springs with an
irrevocable offer to dedicate which offer, if not exercised,
shall expire in ten (10) to twenty (20) years. If a fire
station is to be built by the City of Palm Springs within the
ten (10) to twenty (20) year period the applicant will, at the
time of commencement of construction, dedicate the site to the
City of Palm Springs. Specific offer of dedication details
shall be incorporated into the development agreement.
41. Prior to the issuance of any permits, the project applicant
shall execute "Avigation easement and nonsuit covenant" in a
form prescribed and approved by the City Attorney with the
Palm Springs Regional Airport for the VOU's.
42 . The Classic landscape plan shall be utilized as the master
landscape plan for all future developments along Gene Autry
Trail.
43 . The street frontage landscaping for the commercial/industrial
in the area shall occur when the property is subdivided.
PHASE 1
STATE HIGHWAY 111 - GENE AUTRY TRAIL
* 44 . Dedicate an additional right-of-way of 5 feet to provide
the ultimate half street width of 55 feet along the
entire frontage, together with a 25 foot radius property
line return at the Northeast and Southeast corners of the s �,
intersections of Classic Drive and Gene Autry Trail. „' Cp

47 . Developer shall obtain State permits and approval of plans for
all work done on State Highway ill prior to the City of Palm
Springs issuing any construction permits.
48 . Construct the NORTH AND SOUTH halves of an 8 foot cross gutter
and spandrel at the intersection of GENE AUTRY TRAIL and
CLASSIC DRIVE with a flow line parallel to the centerline of
GENE AUTRY TRAIL in accordance with City of Palm Springs
Standard Drawing Nos. 206 and 207 .
49. Construct a 10 foot wide Class I meandering pedestrian/bicycle
path (Caltrans Design Manual, Chapter 1000 - Bikeway Planning
and Design) along the entire frontage. The bicycle path shall
be constructed of Portland cement concrete with an admixture
as manufactured by LM Scofield Co. , Chromix C-11, Desert Sand
color, or approved equal, and the concrete shall receive a
broom finish.
50. Construct a ramp for the physically handicapped at the
NORTHEAST AND SOUTHEAST corners of the intersection of Gene
Autry Trail and Classic Drive in accordance with City of Palm
Springs Standard Drawing No. 212 .
51. Construct a ramp for the physically handicapped at the
NORTHWEST corner of the subject property in accordance with
City of Palm Springs Standard Drawing No. 212 .

Standards Manual on the northeast corner of the
intersection of Classic Drive and Gene Autry Trail. The
northeast curb return shall be recessed east 12 feet. The
north end of the bus turn out shall have the standard
reverse curves to meet existing curb and gutter on Gene
Autry Trail. Developer shall contact SunLine Transit
Agency to arrange for furniture and utilities for the bus
stop.
53 . Developer shall landscape one-half of their proportionate
share of the median island fronting the Project. The landscape
plan shall be approved by the Planning Director.
Developer shall enter into a maintenance agreement to maintain
planted median island along the entire property frontage (as
applicable) . These requirements shall be subject to the
approval of the City Engineer. If a Local or City-wide Medianf
Island Maintenance District is formed, this condition shall be
considered met if the island is assessed similar to other
lands in the maintenance district and contributes its share
towards median island maintenance.
54 . Developer shall be responsible for the full intersection G
construction of Gene Autry Trail at Classic Drive and for all
associated median cuts, closures, and driveway relocations �d
off-site.

55. Easements shall be granted for the portions of the
sidewalk/bicycle path and bus turn out that leave the public
right-of-way.
56. Any improvements within the street right-of-way require a City
of Palm Springs Encroachment Permit. Work shall be allowed
according to Resolution 17950 - Restricting Street Work on
Major and Secondary Thoroughfares.
57 . Construct the EAST AND WEST halves of an 8 foot cross gutter
and spandrel at the intersection of VISTA CHINO ROAD EAST and
BIRD CENTER DRIVE with a flow line parallel to the centerline
of VISTA CHINO ROAD EAST in accordance with City of Palm
Springs Standard Drawing Nos. 206 and 207 .
58 . All driveway approaches shall be constructed in accordance
with City of Palm Springs Standard Drawing No. 205. The
driveway widths must conform to the Institute of Traffic
Engineers "Guidelines for Driveway Design and Location" .
59 . Construct a ramp for the physically handicapped at the
SOUTHEAST AND SOUTHWEST corners of the intersection of Vista
Chino Road East and Bird Center Drive in accordance with City
of Palm Springs Standard Drawing No. 212 .
60. Construct a 10 foot wide Class I meandering bicycle path
(Caltrans Design Manual, Chapter 1000 - Bikeway Planning and
Design) along the entire frontage. The bicycle path shall be
constructed of Portland cement concrete with an admixture as
manufactured by LM Scofield Co. , Chromix C-11, Desert Sand
color, or approved equal, and the concrete shall receive a
broom finish.
61. All broken or off grade CURB, GUTTER AND AC PAVEMENT shall be
repaired or replaced.
* 62 . Construct a 14 foot wide desert landscaped, raised median
island as specified by the City Engineer from Gene Autry
Trail to Bird Center Drive. Provide a 130 foot left turn
pocket plus transition (60 feet) on the east side of the
Vista Chino Road East at Gene Autry Trail intersection.
Provide a 30 foot long left turn pocket on the west side
of the Vista Chino Road East at Executive Drive
intersection. The nose width shall be 2 feet wide and
shall have stone cobbles to the point where the
desertscape can begin. Developer shall enter into a
maintenance agreement to maintain planted median island
along the entire property frontage (as applicable) . These
requirements shall be subject to the approval of the City
Engineer. If a Local or City-wide Median Island
Maintenance District is formed, this condition shall be
considered met if the island is assessed similar to other
lands in the maintenance district and contributes its
share towards median island maintenance. Q!
CLASSIC DRIVE

63 . Full-street right-of-way is required to an ultimate width of � I
120 feet and shall be dedicated to the City of Palm Springs
for road and utility purposes.

64 . Construct an 8 inch curb and gutter, per City of Palm Springs
Standard Drawing No. 200A, 26 feet both sides of median island
barrier curb along the entire frontage, with a 35 foot radius
curb return at the NORTHEAST AND SOUTHEAST corners of the Gene
Autry Trail/Classic Drive intersection.
65 . All driveway approaches shall be constructed in accordance
with City of Palm Springs Standard Drawing No. 205. The
driveway widths must conform to the Institute of Traffic
Engineers "Guidelines for Driveway Design and Location" .

CLASSIC DRIVE. The construction shall be adjaeent te

67. Construct a ramp for the physically handicapped at all
driveway intersections of Classic Drive in accordance with
City of Palm Springs Standard Drawing No. 212 .
68 . Construct a 20 foot wide landscaped, raised median island as
specified by the City Engineer from Gene Autry Trail to the
cul-de-sac. Provide turn pockets as required for traffic
circulation to the vacation ownership units. The nose width
shall be 4 feet wide and shall have stone cobbles to the point
where the landscape can begin. Developer shall enter into a
maintenance agreement to maintain planted median island along
the entire property frontage (as applicable) . These
requirements shall be subject to the approval of the City
Engineer. If a Local or City-wide Median Island Maintenance
District is formed, this condition shall be considered met if
the island is assessed similar to other lands in the
maintenance district and contributes its share towards median
island maintenance.
69 . Construct a minimum pavement section of 5 inch asphalt
concrete pavement over 4 inch Class II aggregate base with a
minimum subgrade of 24 inches at 95% relative compaction, OR
equal, from edge of proposed gutter to edge of proposed
barrier curb along the entire length of Classic Drive in
accordance with City of Palm Springs Standard Drawing No. 110.
The pavement section shall be designed, using "R" values, by
a licensed Soils Engineer and submitted to the City Engineer
for approval.
TACHEVAH DRIVE

an ultimate width of 33 feet and shall be dedicated to
the City of Palm Springs for road and utility purposes.
Dedicate additional right-of-way to provide for a cul-de-
sac at the eastern terminus of Tachevah Drive.
71. Construct a 6 inch curb and gutter, per City of Palm Springs
Standard Drawing No. 200, 25 feet both sides of centerline
along the entire frontage and continuing around the cul-de-sack
at the eastern terminus of Tachevah Drive. Z U,

BIRD CENTER DRIVE
76. Full-street right-of-way is required to an ultimate width of
66 feet and shall be dedicated to the City of Palm Springs for
road and utility purposes, together with 35 foot radius
property line returns at the intersection of Vista Chino Road
East and Bird Center Drive.
77 . Construct a 6 inch curb and gutter, per City of Palm Springs
Standard Drawing No. 200, 25 feet BOTH SIDES of centerline
along the entire frontage, with a 35 foot radius curb return
at the intersection of Vista Chino Road East and Bird Center
Drive.
78. Construct the EAST AND WEST halves of an 8 foot cross gutter
and spandrel at the intersection of VISTA CHINO ROAD EAST and
BIRD CENTER DRIVE with a flow line parallel to the centerline
of VISTA CHINO ROAD EAST in accordance with City of Palm
Springs Standard Drawing Nos. 206 and 207.
79 . All driveway approaches shall be constructed in accordance
with City of Palm Springs Standard Drawing No. 205. The
driveway widths must conform to the Institute of Traffic
Engineers "Guidelines for Driveway Design and Location" .
80. Construct a minimum 8 foot wide sidewalk behind the curb along
the entire frontage in accordance with City of Palm Springs
Standard Drawing No. 210.
81. Construct a ramp for the physically handicapped at the
intersections of Vista Chino Road East and both sides of all
driveway approaches of the subject property in accordance with
City of Palm Springs Standard Drawing No. 212 .
82 . Construct a minimum pavement section of 3 inch asphalt
concrete pavement over 6 inch Class II aggregate base with a
minimum subgrade of 24 inches at 95% relative compaction, OR
equal, from edge of proposed/existing gutter to centerline CAI
along the entire frontage in accordance with City of Palm \'
Springs Standard Drawing No. 110 and 310. The pavement section
shall be designed, using "R" values, by a licensed Soils
Engineer and submitted to the City Engineer for approval. � 4

82A. The developer shall dedicate a half street right-of-way of 30
feet via an irrevocable offer to the City of Palm Springs for `= "-
road and utility purposes along the Classic frontage from the
southeasterly corner of the Classic project site and adjacent
to and west of the east property line extending approximately
2 , 710 feet northerly to the northwesterly corner of the
subject 9.26 acre plus or minus property.

85. Connect all sanitary facilities to the City sewer system.
86. Construct sewer laterals from existing sewer main to a
location in the proximity of the plumbing outlet of said
property. Cap all laterals at right-of-way line for future
connection to City sewer system.
GENERAL
87 . Developer shall construct an 8 inch sewer main across the
entire CLASSIC DRIVE frontage in accordance with the Master
Plan of Sewers and connect to the existing sewer system at
GENE AUTRY TRAIL.
88. The Title Report prepared for subdivision guarantee for the
subject property and the traverse closures for the existing
parcel and all lots created therefrom shall be submitted with
the Parcel Map or Final Map to the Engineering Division.

AUTRY TRIAL and CLASSIC DRIVE.
106 . The developer shall install an 8 phase traffic signal at VISTA
CHINO ROAD EAST and BIRD CENTER DRIVE. A reimbursement
agreement for 50 % of the cost of the installation shall be
entered into by the developer and the City. The agreement
shall be executed and submitted to the Engineering Division
prior to the issuance of the building permit.
107 . The developer shall install an 8 phase traffic signal at GENE
AUTRY TRAIL and TACHEVAH DRIVE. A reimbursement agreement for
50 % of the cost of the installation shall be entered into by
the developer and the City. The agreement shall be executed

108 . Construct a 6 inch curb and gutter, per City of Palm Springs
Standard Drawing No. 200, 19 feet BOTH SIDES of centerline
along the entire frontage, with a 25 foot radius curb return
at the interior intersections of the subject property.
109 . Construct a full 6 foot cross gutter and spandrel at the
intersections as required in accordance with City of Palm
Springs Standard Drawing Nos. 206 and 207.
110. All driveway approaches shall be constructed in accordance
with city of Palm Springs standard Drawing No. 201. The
driveway widths must conform to the Institute of Traffic
Engineers "Guidelines for Driveway Design and Location" .
111. Construct a ramp for the physically handicapped at all corners
of all intersections with sidewalks of the subject property in
accordance with City of Palm Springs Standard Drawing No. 212 .
112 . Construct a minimum pavement section of 2-1/2 inch asphalt
concrete pavement over 4 inch class II aggregate base with a
minimum subgrade of 24 inches at 95% relative compaction, OR
equal, from edge of proposed gutter to edge of proposed gutter
along the entire frontage in accordance with City of Palm
Springs Standard Drawing No. 110. The pavement section shall
be designed, using "R" values, by a licensed Soils Engineer
and submitted to the City Engineer for approval.
ON-SITE
113 . The following requirements for a gated entry shall be met to
provide adequate setbacks and turning movements for vehicles
entering the primary parking facilities of this project:
A. Provide a minimum curb cut of 60 feet
B. Provide a minimum 50 foot setback to the access gate
control mechanism
C. Provide a turnaround after the mechanism for vehicles
unable to enter the project
