HomeMy WebLinkAbout18493 - RESOLUTIONS - 10/19/1994 RESOLUTION NO. 18493 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING CERTIFICATION OF THE ENVIRONMENTAL IMPACT REPORT AS COMPLETE, ADOPTION OF THE CORRESPONDING STATEMENT OF FACTS & FINDINGS, ADOPTION OF THE STATEMENT OF OVERRIDING CONSIDERATIONS AND , ADOPTION OF THE MITIGATION MONITORING PROGRAM RELATING TO CASE 5. 0666-PLANNED DEVELOPMENT DISTRICT 231 FOR A MIXED USE PROJECT COMPOSED OF UP TO 400 ROOM HOTEL, UP TO 500 VACATION OWNERSHIP UNITS (V.O.U. 's) , 27 HOLE GOLF COURSE AND CLUBHOUSE, TENNIS COMPLEX„ OFFICE AND RETAIL RELATED USES, A GENERAL PLAN AMENDMENT TO DELETE THE FIRE STATION DESIGNATION AND DELETION OF THE EXTENSION OF AVENUE 30 FROM THE PROJECT SITE A19D FOUR ALTERNATIVE DEVELOPMENT SCENARIOS ON 369 . 5 ACRES FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF VISTA CHINO AND GENE AUTRY TRAIL, W- 0-5 AND M-I-P ZONES, SECTIONS 7 AND 18. WHEREAS, D.T. Palm Springs Inter-Continental Golf Center Enterprises, Ltd. , (the "Applicant") has filed an application with the City pursuant to Section 9403 . 00 for a Planned Development District for a mixed-use development composed of up to 400 room hotel, up to 500 two-bedroom Vacation Ownership Units (VDU's) , 28.8 acres of research and development, office/commercial and light industrial uses, a 27 hole golf course, tennis complex and support facilities, and a General Plan Amendment to delete the fire station ' designation and delete the extension of Avenue 30 from the project site and four alternative scenarios (the "Project:.") , located at the southeast corner of Vista Chino and Gene Autry Trail, W-I4-1-P and W-0-5 Zones, Sections 7 and 18; and WHEREAS, the Applicant has filed a General Plan Amendment and a Planned Development District application with the City and has paid the required filing fees; and WHEREAS, the proposed development is considered a '''project" pursuant to the terms of the California Environmental Quality Act ("CEQA") , and an Environmental :Impact_ Report has; been prepared for this Project and has been distributed for public review and comment in accordance with CEQA; and WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm Springs to consider Applicant's applications for the Project was given in accordance with applicable :Law; and WHEREAS, on September 28, 1994„ a public hearing of the Planning Commission of the City of Palm Springs to consider the Draft EIR was given in accordance: with applicable law; and WHEREAS, on October 12 , 1994 , a public hearing for the Project was held by the Planning Commission in accordance with applicable law; ' and WHEREAS, at the conclusion of its public hearing on October 12 , 1994, the Planning Commission adopted Resolution No. 4316, recommending that the City Council certify the Final Environmental Impact Report as complete and in conformity with CEQA, adoption of the Statement of Overriding Considerations, and adoption of the mitigation monitoring program relating to Case 5. 0666-PD-231, 4(c Res. No. 18493 Page 2 2� subject to those findings and conditions stated in Resolution No. 4316; and WHEREAS, notice of public hearing of the City Council of the City of Palm Springs to consider the certification of the Final Environmental Impact Report as complete and in conformity with CEQA, adoption of the Statement of Overriding Considerations, and ' adoption of the mitigation monitoring program relating to Case 5. 0666-PD-231, was given in accordance with applicable law; and WHEREAS, on October 19, 1994, a public hearing on the Final Environmental Impact Report relating to Case 5. 0666-PD-231, was held by the City Council in accordance with applicable law; and, WHEREAS, pursuant to Government Code Section 66412 . 3 , the City Council considered the effect of the Project, on the housing needs of the region in which Palm Springs is situated and has balanced these needs against the public service needs of its residents and available fiscal and environmental resources; the approval of the proposed Subdivision represents the balance of these respective needs in a manner which is most consistent with the City's obligation pursuant to its police powers to protect the public health, safety, and welfare; and WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the Project, including but not limited to the staff report, all environmental data including the initial study, the proposed Environmental Impact Report, and all written and oral testimony presented. THE CITY COUNCIL HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the City Council finds as follows: Pursuant to CEQA, the City Council finds that a final Environmental Impact Report has been prepared and completes in compliance with CEQA, the State CEQA Guidelines, and the City's CEQA Guidelines; the EIR adequately addresses the general environmental setting of the proposed Project, its significant environmental impacts, and the alternatives and mitigation measures related to each significant environmental effect for the proposed Project. The City Council therefore recommends approval and certification of the Environmental Impact Report as complete. Section 2 • The City Council has reviewed and analyzed information contained in the Final Environmental Impact Report prior to taking action on the Planned Development District and the General Plan Amendment and recommends that the City Council certify the Environmental Impact Report as complete. The EIR reflects the independent judgement of the Planning Commission. The City Council further recommends adoption of the Statement of Findings and Facts and incorporates same herein by ' reference. The City Council finds that the mitigation measures identified in the Statement are necessary to reduce or avoid significant impact and that certain impacts, as identified in the Statement, even with implementation of all recommended mitigation measures, will remain significant and further recommends adoption of the Statement of Overriding Considerations and incorporates same herein by reference. Res. No. 18493 Page 3 Section 3. By adoption of this resolution, the City Council recommends adoption of the Mitigation Monitoring Program for the Environmental Impact Report for Case 5. 0666-PD-231 and incorporates same '.herein by reference. NOW, THEREFORE, BE IT 'RESOLVED that, based upon the foregoing, ' the City Council approves the certification of the Final Environmental Impact Report as complete and in conformity with CEQA, adoption of the Statement of Overriding Considerations, and adoption of the mitigation monitoring program relating to Case 5. 0666-PD-231.
