HomeMy WebLinkAbout18486 - RESOLUTIONS - 10/5/1994RESOLUTION NO. 18486 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CK[J FORNIA, ORDERING ANNEXATION WITHOUT ELECTION OF ANNEXATION 26 AS APPROVED BY THE RIVERSIDE LOCAL AGENCY FORMATION COMMISSION, LAFCO NO. 93-28-3, AND APPROVING AN AGREEMENT BETWEEN THE CITY OF PALM SPRINGS AND THE COUNTY OF RIVERSIDE AS A CONDITION OF ANNEXATION. WHEREAS the City Council of. the City of Palm springs desires to annex approximately 8,000 acres of legally uninhabited land which is now under the jurisdiction of the County of Riverside generally located in the Interstate 10 corridor, between State Highway III and Gene Autry Trail, north of the existing corporate limit of the City of Palm Springs, as more particularly described in Exhibit A attached hereto; and WHEREAS the Riverside Local Agency Formation Commission (L)kFCO) has approved the annexation of Annexation 26 at a public hearing held on October 28, 1993, subject to the condition that the City of Palm Springs enter into an agreement with the County of Riverside regarding the provision of fire and police protection services by the City within the Snow Creek and Windy Point areas and regarding the continuity of permit processing for WECS proposals (Agreement); and WHEREAS the annexation will take place without an election of the eligible electorate because no property owner in the territory has filed a written protest with the City; and WHEREAS the annexation was initiated by the City of Palm Springs following requests by property owners in the territory; and WHEREAS the regular County Assessment Roll will be utilized with respect to the annexed property; and WHEREAS the annexed territory is not now taxed for existing general bonded indebtedness by either the City of Palm Springs or the County of Riverside; and WHEREAS the City Council. has the authority to order such annexation pursuant to the Cortese -Knox Act of 1985, Government Code Section 57,000 et seq, and the City desires to order the annexation and approve the execution of the Agreement which the City Council has determined to be in the best interest of the City of Palm Springs. NOW, THEREFORE, BE IT RESOLVED that the City Coulricil of the City of Palm Springs, California, hereby orders the annexation of Annexation 26 and also authorizes the execution, by the City Manager, of that certain Agreement, required by LAFCO as a condition of annexation, a copy of which is in the office of the City Clerk.
